THE EUROPEAN COMMUNITIES (SHARING OF PASSENGER CAPACITY AND ACCESS TO SCHEDULED AIR SERVICE ROUTES) REGULATIONS, 1989.

THE EUROPEAN COMMUNITIES (SHARING OF PASSENGER CAPACITY AND ACCESS TO SCHEDULED AIR SERVICE ROUTES) REGULATIONS, 1989.

I, SEAMUS BRENNAN, Minister for Tourism and Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Decision No. 87/602/EEC of 14 December, 1987(1), hereby make the following Regulations:

(1)O.J. No. L374/19, 31.12.1987, PP. 19-26.

1. These Regulations may be cited as the European Communities (Sharing of Passenger Capacity and Access to Scheduled Air Service Routes) Regulations, 1989, and shall be deemed to have come into operation on the 1st day of January, 1988.

2. In these Regulations:

"the Council Decision" means Council Decision No. 87/602/EEC of 14 December, 1987(1);

"the Minister" means the Minister for Tourism and Transport.

3. A word or expression that is used in these Regulations and is also used in the Council Decision has, unless the contrary intention appears, the same meaning in these Regulations as it has in the Council Decision.

4. The sharing of passenger capacity between air carriers registered in the State and the air carriers of other Member States on scheduled air services between the State and other Member States shall be in accordance with the provisions of the Council Decision.

5. (1) The Air Service Authorisation Order, 1966 ( S.I. No. 95 of 1966 ), is hereby amended by the insertion after paragraph (i) of Article 3 (inserted by the Air Services Authorisation (Amendment) Order, 1976 ( S.I. No. 201 of 1976 )), of the following:

"(j) air services operated in accordance with the provisions of Articles 5 to 8 of Council Decision No. 87/602/EEC of 14 December, 1987".

(2) The Minister shall accept and permit the market access provisions of the Council Decision in accordance with the provisions of that Decision.

EXPLANATORY NOTE

The purpose of these Regulations is to implement Council Decision No. 87/602/EEC which lays down rules for the sharing of passenger capacity between air carriers on scheduled air services between Member States and for access for air carriers to scheduled air service routes between Member States.
