AIR POLLUTION ACT, 1987 (RETAIL SALE OF FUELS) REGULATIONS 1989.

In exercise of the powers conferred on the Minister for the Environment by section 10 and section 53 of the Air Pollution Act, 1987 (No. 6 of 1987), which said powers are delegated to me by the Environment (Delegation of Ministerial Functions) Order, 1989 ( S.I. No. 270 of 1989 ), I, Mary Harney, Minister of State at the Department of the Environment, hereby make the following Regulations:--

1. (1) These Regulations may be cited as the Air Pollution Act, 1987 (Retail Sale of Fuels) Regulations, 1989.

(2) These Regulations shall come into operation on the 1st day of January, 1990.

2. In these Regulations, "the built-up area of Dublin" means the county borough of Dublin together with the administrative county of Dublin other than the excluded areas of that county specified in the Schedule to these Regulations.

3. (1) Any person who, for the time being at any premises which is situated in the built-up area of Dublin or from any vehicle which for the time being is located within the built-up area of Dublin, has a supply of bituminous coal for sale by retail, shall also have for sale by retail, at such premises or from such vehicle, at all reasonable times and in reasonable quantities, a supply of one or more of the following smokeless or low-smoke fuels:--Coalite, Bord na Mona peat briquettes, Rheinbraun union coal nuggets/briketts.

(2) The requirements of sub-article (1) of this article shall not apply in the case of a vehicle which is being used solely for the purpose of delivering a supply of bituminous coal on foot of a prior order or orders therefor.

Article 2

SCHEDULE

Excluded areas of the administrative county of Dublin.

1. The District Electoral Divisions of--

Balbriggan Rural Holmpatrick
Balgriggan Urban Kilsallaghan
Ballinascorney Lusk
Ballyboghil Newcastle
Balscadden Rathcoole
Bohernabreena Rush
Clonmethan Saggart
Donabate Skerries
Garristown Tibradden
Hollywood

2. That part of the District Electoral Division of Swords -- Lissenhall situated north of the Broad Meadow River.

3. That part of the District Electoral Division of Glencullen situated west of an imaginary line drawn as follows:--Commencing at the junction of Slate Cabin Lane and Woodside Road, thence in a south-easterly direction and proceeding along Woodside Road and Ballyedmonduff Road to the county boundary at Glencullen Bridge.

EXPLANATORY NOTE.

These Regulations require retailers of bituminous coals in the built up area of Dublin to have a supply of one or more specified smokeless or low-smoke solid fuels for sale by retail from vehicles or at premises, as appropriate. The requirements do not apply to vehicles being used solely for delivering coals on foot of a prior order or orders therefor. The Regulations come into operation on 1st January, 1990.
