INLAND POST AMENDMENT (No. 44) SCHEME, 1989

INLAND POST AMENDMENT (No. 44) SCHEME, 1989

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), and with the consent of the Minister for Communications, hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Inland Post Amendment (No. 44) Scheme, 1989.

(2) This Scheme shall come into operation on the 1st day of January, 1990.

2. In this Scheme

"the Principal Warrant" means the Inland Post Warrant, 1939 ( S.I. No. 202 of 1939 ).

"Scheme No. 37" means the Inland Post Amendment (No. 37) Scheme, 1986 ( S.I. No. 92 of 1986 ).

3. Regulation 37 of the Principal Warrant is hereby amended by the substitution for that Regulation of the following:

"Subject to the provisions of this Warrant, any postal packet (other than a parcel for delivery within the State) may be registered".

4. Regulation 5 of the Inland Post Amendment (No. 5) Warrant, 1953 (inserted by Regulation 12 of the Inland Post Amendment (No. 19) Warrant, 1974 ( S.I. No. 280 of 1974 ), and as amended by Regulation 11 of the Inland Post Amendment (No. 29) Scheme, 1985 ( S.I. No. 137 of 1985 )), is hereby amended by the substitution for "twenty-five pounds" of "forty pounds".

5. Regulation 3 (2) (ii) of the Inland Post Amendment (No. 30) Scheme, 1985 ( S.I. No. 396 of 1985 ), is hereby amended by the substitution for "twenty pounds" or "£20" of "twenty-five pounds".

6. Regulation 8 of the Inland Post Amendment (No. 31) Scheme, 1985 ( S.I. No. 94 of 1985 ), is hereby deleted.

7. ( a ) Regulation 6 (b) of the Inland Post Amendment (No. 33) Scheme, 1985 ( S.I. No. 444 of 1985 ), is hereby amended by the substitution for "5p" of "6p".

( b ) Regulation 8 (a) of Inland Post Amendment (No. 33) Scheme, 1985 ( S.I. No. 444 of 1985 ), is hereby amended by the substitution for "twenty-five pounds" or "£25" of "forty pounds".

8. Regulation 7 (a) of the Inland Post Amendment (No. 34) Scheme, 1985 ( S.I. No. 445 of 1985 ), is hereby amended by substitution for "twenty five pounds" of "forty pounds".

9. The First Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 6 of Scheme No. 37) and Regulation 3 of the Inland Post Amendment (No. 39) Scheme, 1986 ( S.I. No. 463 of 1986 ) of the entries in the First Schedule to this Scheme.

10. The Second Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 7 of Scheme No. 37) of the entries in the Second Schedule to this Scheme.

11. The Third Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 8 of Scheme No. 37) of the entries in the Third Schedule to this Scheme.

12. The Fourth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 9 of Scheme No. 37) of the entries in the Fourth Schedule to this Scheme.

13. The Fifth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 10 of Scheme No. 37) of the entries in the Fifth Schedule to this Scheme.

14. The First Schedule to the Inland Post Amendment (No. 31) Scheme, 1985 ( S.I. No. 94 of 1985 ), inserted by Regulation 3 of the Inland Post Amendment (No. 38) Scheme, 1986 ( S.I. No. 93 of 1986 ), is hereby amended by the substitution for the entries therein of the entries in Section 9 of the First Schedule to this Scheme.

1. Late Fee Postal Packet A fee (in addition to postage) not exceeding 12p as may be prescribed. A packet upon which no part, or a part only, of the fee payable is paid shall be liable to a surcharge of the deficiency plus a handling fee of 20p.
2. Certificate of posting (issued at the request of the sender of an unregistered postal packet other than a parcel) Free of Charge The service is subject to such rules as may be prescribed.
3. Certificate of Delivery (obtained and forwarded to the sender of a registered postal packet at his request).

Conveyance by special messenger of a postal packet throughout the whole of the service demanded or through part only of its course in the post. For delivery in Ireland a minimum charge of 55p within the state only plus at the rate of 70p for each 1 km or part thereof. These charges also include express delivery items sent for delivery to Britain.
Writing down of Express message received by telephone. A fee (in addition to the appropriate telephone fee and appropriate distance fee) of 55p. To be collected from addressee.

EXPLANATORY NOTE

This Scheme applies to the Inland Post Service and comes into operation on the 1st day of January, 1990. It authorises increases in the letter, postcard, printed packet, newspaper, sample packet and parcel post rates of postage and in the fees charged for the express delivery, registration, customs clearance, cash-on-delivery, Business Reply, Freepost, Parcel Sure-Service, Parcel Forward and other miscellaneous services.
