INDUSTRIAL RESEARCH AND STANDARDS (SECTION 44) (PERAMBULATORS AND PUSHCHAIRS) ORDER, 1990. |

I, MICHAEL SMITH, Minister of State at the Department of Industry and Commerce, in exercise of the powers conferred on me by section 44 of the Industrial Research and Standards Act, 1961 (No. 20 of 1961), and by the Industry and Commerce (Delegation of Ministerial Functions) Order, 1989 (No. 225 of 1989), hereby make the following Order: |

1. This Order may be cited as the Industrial Research and Standards (Section 44) (Perambulators and Pushchairs) Order, 1990. |
||
2. This Order shall come into operation on the 22nd day of October, 1990. |
||
3. In this Order "perambulator'' and "pushchair" have the meaning assigned to them, respectively, by Irish Standard 209:1988. |
||
4. This Order applies to any perambulator or pushchair which is intended for sale to the public in the State. |
||
5. It shall be unlawful to manufacture, assemble or sell a perambulator or pushchair to which this Order applies unless: |
||
( a ) it complies with Irish Standard 209: 1988 (I.S. 209: 1988); or |
||
( b ) it complies with a Standard or another Member State of the European Community provided that such Standard guarantees a level of safety and reliability which is equivalent to Irish Standard 209:1988. |
||
6. Notwithstanding section 10 (4) of the Petty Sessions (Ireland) Act, 1851, proceedings for an offence under this Order, committed after the commencement of this Order, may be instituted within 12 months from the date of the offence. |
||
7. The Industrial Research and Standards (Section 44) (Perambulators and Pushchairs) Order, 1981 ( S.I. No. 212 of 1981 ), is hereby revoked. |

EXPLANATORY NOTE. |
||
The purpose of this Order is to prohibit the manufacture, assembly or sale of a perambulator or a pushchair unless it complies with the standard specification for perambulators and pushchairs, Irish Standard 209 of 1988, or with the equivalent standard of another EC Member State. |
||
I.S. 209 of 1988 sets out safety requirements for perambulators and pushchairs. |
