EUROPEAN COMMUNITIES (QUANTITATIVE ANALYSIS OF BINARY AND TERNARY FIBRE MIXTURES) REGULATIONS, 1990.

EUROPEAN COMMUNITIES (QUANTITATIVE ANALYSIS OF BINARY AND TERNARY FIBRE MIXTURES) REGULATIONS, 1990.

I, DESMOND O'MALLEY, Minister for Industry and Commence, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 72/276/EEC of 17 July 19721 (as amended by Commission Directive No. 79/76/EEC of 21 December 19782, Council Directive No. 81/75/EEC of 17 February 19813 and Commission Directive No. 87/184/EEC of 6 February 19874) and to Council Directive No 7¾4/EEC of 26 February 19735 hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Quantitative Analysis of Binary and Ternary Fibre Mixtures) Regulations, 1990, and shall come into operation on the 19th day of November, 1990.

2. (1) In these Regulations--

"competent authority" means Eolas--The Irish Science and Technology Agency or any laboratory that the Minister may designate from time to time;

"Council Directive 7¾4/EEC" means Council Directive No. 7¾4/EEC of 26 February 19735 on the approximation of the laws of the Member States relating to the quantitative analysis of ternary fibre mixtures;

"Council Directive 71/307/EEC" means Council Directive No. 71/307/EEC of 26 July 19716 on the approximation of the laws of the Member States relating to textile names;

"the Directive" means Council Directive No. 72/276/EEC of 17 July 19721 on the approximation of the laws of the Member States relating to certain methods for the quantitative analysis of binary textile fibre mixtures (as amended by Commission Directive No. 79/76/EEC of 21 December 19782, Council Directive No. 81/75/EEC of 17 February 19813 and, Commission Directive No. 87/184/EEC of 6 February 19874);

"the Minister" means the Minister for Industry and Commerce.

(2) A word or expression that is used in these Regulations and is also used in the Directive or Council Directive 7¾4/EEC shall, unless the contrary intention is expressed, have the meaning in these Regulations that it has in those Directives.

3. (1) Eolas--The Irish Science and Technology Agency is hereby designated as a competent authority for the purposes of these Regulations.

(2) All official tests carried out for the purposes of these Regulations shall be carried out by a competent authority.

4. The provision of Annexes I and II to the Directive on methods for the quantitative analysis of certain binary mixtures, including the preparation of test samples and test specimens, shall, in accordance with Council Directive 71/307/EEC, be applied in official tests to determine the composition of textile products put on the market.

5. The provisions of Annex I to Council Directive 7¾4/EEC and in Annex I to the Directive shall be applied in official tests to determine the composition of textile products composed of a ternary fibre mixture put on the market in accordance with Council Directive 71/307/EEC.

6. With regard to the preparation of test samples and test specimens of ternary fibre mixtures the provision of Annex I to the Directive shall be applied in official tests.

7. The competent authority responsible for the testing of ternary mixtures in accordance with these Regulations shall show in the test report all the factors mentioned in point V of Annex I to Council Directive 7¾4/EEC.

8. The competent authority responsible for the testing of binary mixtures for which there is no uniform method of analysis at European Community level shall determine the composition of such mixtures by using any valid method at its disposal, indicating in the analysis report the result obtained and, in so far as this is known, the degree of accuracy of the method used.

EXPLANATORY NOTE.

These Regulations have been made to give effect to Council Directive No. 72/276/EEC of 17 July, 1972 (O.J. No. L 173/1, 31 July, 1972) as amended by Commission Directive No. 79/76/EEC of 21 December, 1978 (O.J. No. L 17/17, 24 January, 1979), Council Directive No. 81/75/EEC of 17 February, 1981 (O.J. No. L 57/23, 4 March, 1981) and Commission Directive No. 87/184/EEC of 6 February, 1987 (O.J. No. L 75/21, 17 March, 1987) relating to the quantitative analysis of binary textile fibre mixtures and Council Directive No. 7¾4/EEC of 26 February, 1973 (O.J. No. L 83/1, 30 March, 1973) relating to the quantitative analysis of ternary fibre mixtures.
