S.I. No. 106/1991:

EUROPEAN COMMUNITIES (SURVEILLANCE OF IMPORTS OF CERTAIN IRON AND STEEL PRODUCTS) REGULATIONS, 1991.

WHEREAS the State has been authorised under the Recommendation of the Commission of the European Communities dated 7 March 1991 (No. 556/91/ECSC)⁽¹⁾ authorising Member States of the European Communities to apply Community surveillance to imports of certain iron and steel products originating in non-Member States other than members of the European Free Trade Association (EFTA) (the conditions and details of which the Commission has determined in that Recommendation);

NOW, I, DESMOND O'MALLEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Surveillance of Imports of Certain Iron and Steel Products) Regulations, 1991.

2. (1) In these Regulations "the Minister" means the Minister for Industry and Commerce.

(2) A reference in these Regulations to a CN code number shall be taken to be a reference to that code number in the integrated tariff of the European Communities (TARIC), as amended from time to time, which said tariff is based on the codes of the combined nomenclature in the Annex to Commission Regulation (EEC) No. 3174/88 of 21 September 1988⁽²⁾ as amended or replaced by any subsequent regulations or decisions of an institution of the European Communities.

3. (1) These Regulations apply to the goods which are specified at a tariff heading and CN code number mentioned in column (1) of the Schedule to these Regulations.

(2) The particulars mentioned in column (2) of the Schedule to these Regulations are inserted solely to facilitate identification of the goods specified at the tariff heading and CN code number mentioned in column (1) of that Schedule opposite the insertion in column (2), and accordingly nothing contained in column (2) shall affect the construction or limit or control the operation of any provision of these Regulations (including the mention of the tariff heading and CN code number in column (1)).

4. With the exception of goods in free circulation in other Member States of the European Community or goods originating in EFTA countries, the importation into the State of any goods under these Regulations shall be subject to the production by the importer of an import document issued by the Minister on the application of the importer made in compliance with the provisions of Commission Recommendation No. 566/91/ECSC, Articles 1 and 2 whereof are set out for information in the Annex to these Regulations.

5. Any person who for the purpose of obtaining for himself or any other person an import document, makes any statement or representation or presents or lodges any document in respect of an application for any such import document which is to his knowledge false in any material respect shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000 or to imprisonment for a term not exceeding 2 years or to both.
