AIR SERVICES AUTHORISATION (AMENDMENT) ORDER, 1992.

I, MÁIRE GEOGHEGAN-QUINN, Minister for Tourism, Transport and Communications, in exercise of the powers conferred on me by section 7 of the Air Navigation and Transport Act, 1965 (No. 6 of 1965), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1991 ( S.I. No. 25 of 1991 ), hereby order as follows:

1. This Order may be cited as the Air Services Authorisation (Amendment) Order, 1992, and shall come into operation on the 15th day of April, 1992.

2. Article 3 (as inserted by Article 2 of the Air Services Authorisation (Amendment) Order, 1976 ( S.I. No. 201 of 1976 )) of the Air Services Authorisation Order, 1966 ( S.I. No. 95 of 1966 ), is hereby amended by the insertion in Article 3 of the following paragraph:--

"3A. This Order shall not apply to any aircraft taking off from, landing in or flying over the territory of the State if the aircraft is destined to land in or has taken off from the territory of Libya, except when the aircraft is engaged in a particular flight which has been approved on grounds of significant humanitarian need by the Committee established by paragraph 9 of Resolution 748 (1992) of the United Nations Security Council."

EXPLANATORY NOTE.

The purpose of this Instrument is to enable the Minister to give effect to United Nations Security Council Resolution 748 on sanctions against Libya as it applies to civil aviation.
