ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF MONAGHAN) REGULATIONS, 1992

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:--

Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1992.

Commencement.

2. These Regulations shall come into operation on the 1st day of October, 1992.

Interpretation.

3. In these Regulations save where the context otherwise requires--

"the Act" means the Road Traffic Act, 1961 ;

"built-up area speed limit" and "special speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road;

"National Road" means a road declared to be a National Road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First and Second Schedules to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of an urban district or a town and shall be considered as being within such boundary for the purposes of these Regulations;

"road" means a public road;

Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:--

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

Revocation.

7. The Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1988 ( S.I. No. 119 of 1988 ) are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following road in the town of Ballybay:--

The Monaghan Road for a distance of 115 metres from the town boundary.

2. The following roads in the Urban District of Carrickmacross:--

( a ) The Shercock Road for a distance of 160 metres eastwards from the point where the urban district boundary intersects the southern side of the road.

( b ) The Mullanarry Road for a distance of 336 metres from the urban district boundary.

( c ) The Lurgans Road between the urban district boundary and a point 27 metres south-west of its junction with the Mullanarry Road.

3. The following roads in the Urban District of Castleblayney:--

( a ) The First Bree Road for a distance of 130 metres from the point where the urban district boundary intersects the south-western side of the road.

( b ) The Keady Road for a distance of 104 metres from the urban district boundary.

4. The following roads in the Urban District of Clones:--

( a ) Mullanamoy Lane, Lisnaroe Lane, River Lane.

( b ) The Cavan Road (National Road N54) for a distance of 502 metres from the urban district boundary.

( c ) The Monaghan Road (National Road N54) for a distance of 262 metres from the point where the urban district boundary intersects the north-western side of the road.

5. The following roads in the Urban District of Monaghan:--

( a ) The Latlorcan Road, The Armagh Road.

( b ) The Clones Road (National Road N54) for a distance of 713 metres from the point where the urban district boundary intersects the northern side of the road.

( c ) The Milltown Road between the point where the urban district boundary intersects the southern side of the road and a point 18 metres north-west of its junction with Rope Walk.

( d ) The Coolshannagh Road for a distance of 242 metres from the urban district boundary.

( e ) The Emyvale Road (National Road N2) for a distance of 450 metres from the urban district boundary.

(f) The Killygowan Road for a distance of 100 metres from its junction with the Ballybay Road.

( g ) The Scotstown Road for a distance of 260 metres from the point where the urban district boundary intersects the southern side of the road.

( h ) The Ballybay Road for a distance of 315 metres from the urban district boundary.

( i ) The Old Armagh Road for a distance of 160 metres from the point where the urban district boundary intersects the south-eastern side of the road.

( j ) The Tullyhirm Road between the urban district boundary and a point 30 metres south-east of its junction with the Emyvale Road (National Road N2).

( k ) The Newbliss Road where the said road is a perimeter road.

( l ) The Rossmore Park Road for a distance of 230 metres from its junction with the Newbliss Road.

( m ) The Dunsinare Road for a distance of 30 metres from the urban district boundary.

( n ) The Killyconigan Road for a distance of 45 metres from its junction with the Monaghan-Clones road (National Road N54).

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads adjacent to the town of Ballybay:--

( a ) O'Duffy Terrace.

( b ) The Carrickmacross Road between the boundary of the town of Ballybay and a point 137 metres north-west of its junction with the Creeve Road.

( c ) The Castleblayney Road for a distance of 420 metres from the point where the boundary of the town of Ballybay intersects the southern side of the road.

( d ) The Clones Road for a distance of 190 metres from the boundary for the town of Ballybay.

( e ) The Cootehill Road for a distance of 145 metres from its junction with the Carrickmacross Road.

2. The following roads at Bellanode:--

( a ) The Monaghan-Scotstown road between a point 75 metres east of its junction with the Lemaculla Road and a point 50 metres west of its junction with the Rosslea Road.

( b ) The Rosslea Road for a distance of 80 metres from its junction with the Monaghan-Scotstown road.

( c ) The Smithsborough Road for a distance of 75 metres from its junction with the Rosslea Road.

( d ) The Lemaculla Road between its junction with the Monaghan-Scotstown road and a point 402 metres north-east of its junction with Carrowhatta Lane.

( e ) Carrowhatta Lane for a distance of 50 metres from its junction with the Lemaculla Road.

3. The following roads adjacent to the Urban District of Carrickmacross:--

( a ) The Horse Hill Road.

( b ) The Castleblayney Road (National Road N2) for a distance of 305 metres from the boundary of the urban district of Carrickmacross.

( c ) The Ballybay Road for a distance of 251 metres from its junction with the Castleblayney Road (National Road N2).

( d ) The Ardee Road (National Road N2) for a distance of 586 metres from the point where the boundary of the urban district of Carrickmacross intersects the western side of the road.

( e ) The Crossmaglen Road for a distance of 247 metres from the point where the boundary of the urban district of Carrickmacross intersects the northern side of the road.

( f ) The Dundalk Road for a distance of 20 metres from the boundary of the urban district of Carrickmacross.

4. The following roads at Carrickroe:--

( a ) The Deravoy Road for a distance of 225 metres from its junction with the Derrylea Road.

( b ) The Knockabeany Road for a distance of 87 metres from its junction with the Derrylea Road.

( c ) The Derryhellan Road for a distance of 23 metres from its junction with the Deravoy Road.

( d ) The Derrylea Road for a distance of 180 metres from its junction with the Deravoy Road.

5. The following roads adjacent to the Urban District of Castleblayney:--

( a ) The Connabury Road for a distance of 409 metres from the boundary of the urban district of Castleblayney.

( b ) The Monaghan Road (National Road N2) for a distance of 330 metres from the point where the boundary of the urban district of Castleblayney intersects the north-eastern side of the road.

( c ) The Carrickmacross Road (National Road N2) for a distance of 395 metres from the boundary of the urban district of Castleblayney.

( d ) The Dundalk Road (National Road N53) for a distance of 356 metres from its junction with the Carrickmacross Road (National Road N2).

( e ) The Shercock Road between its junction with the Old Ballybay Road and a point 39 metres north of its junction with the Tattygar Road.

( f ) The Second Bree Road for a distance of 480 metres from its junction with the Shercock Road.

6. The following roads adjacent to the Urban District of Clones:--

( a ) The Scotshouse Road for a distance of 475 metres from the boundary of the urban district of Clones.

( b ) The Newtownbutler Road for a distance of 125 metres from the boundary of the urban district of Clones.

( c ) The Rosslea Road for a distance of 380 metres from the boundary of the urban district of Clones.

7. The following roads at Doohamlet:--

( a ) The Ballybay-Castleblayney road between a point 508 metres west of its junction with the Clonaneor Road and a point 90 metres east of the said junction.

( b ) The Clonaneor Road for a distance of 50 metres from its junction with the Ballybay-Castleblayney road.

( c ) The Rossollus Road for a distance of 45 metres from its junction with the Ballybay-Castleblayney road.

8. The following roads at Drum:--

( a ) The Clones-Cootehill road between a point 686 metres north-west of its junction with the Rockcorry Road and a point 265 metres south-east of the said junction.

( b ) The Newbliss Road for a distance of 274 metres from its junction with the Clones-Cootehill road.

( c ) The Rockcorry Road for a distance of 550 metres from its junction with the Clones-Cootehill road.

( d ) The road connecting the Rockcorry Road with the Newbliss Road.

( e ) The Violet Brae Road for a distance of 65 metres from its junction with the Clones-Cootehill road.

9. The following roads at Emyvale:--

( a ) The Dublin-Derry road (National Road N2) between a point 268 metres south of its junction with the Glaslough Road and a point 244 metres north-west of its junction with the Mullan Road.

( b ) The Glaslough Road for a distance of 311 metres from its junction with the Dublin-Derry road (National Road N2).

( c ) The Mullan Road for a distance of 577 metres from its junction with the Dublin-Derry road (National Road N2).

( d ) The McCready Mills Road for a distance of 70 metres from its junction with the Dublin-Derry road (National Road N2).

( e ) Market House Lane Road for a distance of 230 metres from its junction with the Dublin-Derry road (National Road N2).

( f ) The Mill Race Road.

10. The following roads at Glaslough:--

( a ) Main Street, Barrack Road.

( b ) The Monaghan-Emyvale road between a point 419 metres south of its junction with Main Street and a point 62 metres west of its junction with the Caledon Road.

( c ) The Caledon Road for a distance of 82 metres from its junction with the Monaghan-Emyvale road.

11. The following roads at Inishkeen:--

( a ) The Essexford-Louth road between a point 538 metres west of its junction with the Blackstaff Road and a point 267 metres south-east of the said junction.

( b ) The Blackstaff Road for a distance of 417 metres from its junction with the Essexford-Louth road.

12. The following road at Lough Eglish:--

The Ballybay-Carrickmacross road between a point 56 metres east of its junction with the Castleblayney Road and a point 550 metres south-east of the said junction.

13. The following roads at Newbliss:--

( a ) The Monaghan-Drum road between a point 133 metres north-east of its junction with the Ballybay Road and a point 53 metres south-east of its junction with the Hazel Brae Road.

( b ) The Killeevan Road for a distance of 185 metres from its junction with the Monaghan-Drum road.

( c ) The Ballybay Road for a distance of 139 metres from its junction with the Monaghan-Drum road.

( d ) The Scotshouse Road for a distance of 304 metres from its junction with the Monaghan-Drum road.

( e ) The Hazel Brae Road for a distance of 5 metres from its junction with the Monaghan-Drum road.

14. The following roads at Rockcorry:--

( a ) The Monaghan-Cootehill road between a point 643 metres north-east of its junction with the Newbliss Road and a point 455 metres south-west of its junction with the Ballybay Road.

( b ) The Newbliss Road for a distance of 106 metres from its junction with the Monaghan-Cootehill road.

( c ) The Ballybay Road for a distance of 447 metres from its junction with the Monaghan-Cootehill road.

( d ) The Old Road for a distance of 350 metres from its junction with the Monaghan-Cootehill road.

( e ) The Corkeeran Road for a distance of 80 metres from its junction with the Monaghan-Cootehill road.

15. The following roads at Scotshouse:--

( a ) The Clones-Ballyhaise road between a point 393 metres north-east of its junction with the Belturbet Road and a point 360 metres south of the said junction.

( b ) The Belturbet Road for a distance of 81 metres from its junction with the Clones-Ballyhaise road.

( c ) The Creamery Road for a distance of 300 metres from its junction with Clones-Ballyhaise road.

( d ) The Drum Road for a distance of 50 metres from its junction with the Clones-Ballyhaise road.

16. The following roads at Scotstown:--

( a ) The Monaghan-Knockatallon road between a point 465 metres south-east of its junction with the Tedavnet Road and a point 185 metres north-west of the said junction.

( b ) The Tedavnet Road for a distance of 800 metres from its junction with the Monaghan-Knockatallon road.

( c ) The Smithborough Road for a distance of 308 metres from its junction with the Monaghan-Knockatallon road.

( d ) The Gola Road for a distance of 174 metres from its junction with the Monaghan-Knockatallon road.

( e ) Carrowhatta Lane for a distance of 50 metres from its junction with the Tedavnet Road.

( f ) The Stracrunnion Road for a distance of 40 metres from its junction with the Scotstown-Tedavnet road.

17. The following roads at Smithborough:--

( a ) The Monaghan-Clones road (National Road N54) between a point 201 metres north-east of its junction with the Rosslea Road and a point 487 metres south-west of the said junction.

( b ) The Rosslea Road for a distance of 156 metres from its junction with the Monaghan-Clones road (National Road N54).

18. The following roads at Tedavnet:--

( a ) The Monaghan-Clogher road between a point 112 metres south-west of its junction with the Scotstown Road and a point 269 metres north-east of its junction with the Emyvale Road.

( b ) The Scotstown Road for a distance of 230 metres from its junction with the Monaghan-Clogher road.

( c ) The Emyvale Road for a distance of 80 metres from its junction with the Monaghan-Clogher road.

( d ) The Monaghan (Back) Road for a distance of 55 metres from its junction with the Monaghan-Clogher road.

19. The following roads at Three Mile House:--

( a ) The Monaghan-Newbliss road between a point 302 metres east of its junction with the Corcaghan Road and a point 272 metres south-west of the said junction.

( b ) The Corcaghan Road for a distance of 113 metres from its junction with the Monaghan-Newbliss road.

( c ) The Church Road for a distance of 225 metres from its junction with the Monaghan-Newbliss road.

( d ) The Drumguill Road for a distance of 15 metres from its junction with the Church Road.

20. The following road adjacent to the Urban District of Monaghan:--

The Castleblayney Road for a distance of 106 metres from the urban district boundary.

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 m.p.h. is prescribed.

1. The following roads at Annayalla:--

( a ) The Monaghan-Castleblayney road (National Road N2) between a point 295 metres north-west of its junction with the Cremartin Road and a point 360 metres south-east of the said junction.

( b ) The Cremartin Road for a distance of 90 metres from its junction with the Castleblayney-Monaghan road (National Road N2).

( c ) The Keady Road for a distance of 65 metres from its junction with the Monaghan-Castleblayney road (National Road N2).

2. The following roads adjacent to the town of Ballybay:--

( a ) The Carrickmacross Road between a point 137 metres north-west of its junction with the Creeve Road and a point 70 metres south-east of the said junction.

( b ) The Creeve Road for a distance of 70 metres from its junction with the Carrickmacross Road.

3. The following roads in and adjacent to the Urban District of Carrickmacross:--

( a ) The Shercock Road between a point 160 metres east of the point where the boundary of the urban district of Carrickmacross intersects the southern side of the road and a point 60 metres north-west of the said intersection.

( b ) The Castleblayney Road (National Road N2) between a point 305 metres north of the boundary of the urban district of Carrickmacross and a point 724 metres north of the said boundary.

( c ) The Ballybay Road between a point 251 metres north-west of its junction with the Castleblayney Road (National Road N2) and a point 685 metres north-west of the said junction.

( d ) The Drumcondra Road for a distance of 989 metres from its junction with the Ardee Road (National Road N2).

( e ) The Dundalk Road between a point 20 metres south-east of the boundary of the urban district of Carrickmacross and a point 1,115 metres south-east of the said boundary.

(f) The Killanny Road for a distance of 55 metres from its junction with the Dundalk Road.

( g ) The Ardee Road (National Road N2) between a point 586 metres south of the point where the boundary of the urban district of Carrickmacross intersects the western side of the road and a point 841 metres south of the said intersection.

( h ) The Castleblayney Road (National Road N2) for a distance of 87 metres from its junction with the (new) Castleblayney Road.

4. The following roads in and adjacent to the Urban District of Castleblayney:--

( a ) The Carrickmacross Road (National Road N2) between a point 395 metres south of the boundary of the urban district of Castleblayney and a point 1,074 metres south of the said boundary.

( b ) The Monaghan Road (National Road N2) between a point 330 metres north-west of the point where the boundary of the urban district of Castleblayney intersects the north-eastern side of the road and a point 73 metres north-west of its junction with the Ballybay Road.

( c ) The Dundalk Road (National Road N53) between a point 356 metres east of its junction with the Carrickmacross Road (National Road N2) and a point 1,008 metres south-east of the said junction.

( d ) The Ballybay Road for a distance of 105 metres from its junction with the Monaghan Road (National Road N2).

5. The following roads in and adjacent to the Urban District of Clones:--

( a ) The Newtownbutler Road between a point 125 metres south-west of the boundary of the urban district of Clones and a point 339 metres south-west of the said boundary.

( b ) The Monaghan Road (National Road N54) between a point 262 metres south-west of the point where the boundary of the urban district of Clones intersects the north-western side of the road and a point 200 metres north-east of the said intersection.

6. The following roads at Clontibret:--

( a ) The Monaghan-Castleblayney road (National Road N2) between a point 429 metres north-west of its junction with the Carrickaderry Road and a point 196 metres south-east of its junction with the Keady Road.

( b ) The Carrickaderry Road for a distance of 90 metres from its junction with the Monaghan-Castleblayney road (National Road N2)

( c ) The Scotscorner Road for a distance of 7 metres from its junction with the Monaghan-Castleblayney road (National Road N2).

( d ) The Keady Road for a distance of 51 metres from its junction with the Monaghan-Castleblayney road (National Road N2).

( e ) The Moys Road between a point 60 metres east of its junction with the Monaghan-Castleblayney road (National Road N2) and a point 400 metres east of the said junction.

7. The following roads in and adjacent to the Urban District of Monaghan:--

( a ) The Armagh Road between its junction with the Emyvale Road and a point 125 metres north-east of the boundary of the urban district of Monaghan.

( b ) The Castleblayney Road (National Road N2) between a point 106 metres south-east of the boundary of the urban district of Monaghan and a point 600 metres south-east of the said boundary.

( c ) The Ballybay Road between a point 315 metres north-west of the boundary of the urban district of Monaghan and a point 80 metres south-east of the said boundary.

( d ) The Clones Road (National Road N54) between a point 713 metres north-east of the point where the boundary of the urban district of Monaghan intersects the northern side of the road and a point 170 metres west of the said intersection.

( e ) The Newbliss Road between its junction with the Clones Road (National Road N54) and a point 50 metres north-east of the point where the boundary of the urban district of Monaghan intersects the south-eastern side of the road.

( f ) The Scotstown Road between a point 260 metres east of the point where the boundary of the urban district of Monaghan intersects the southern side of the road and a point 127 metres north-west of the said intersection.

( g ) The Latlorcan Road between its junction with the Castleblayney Road (National Road N2) and a point 175 metres south-east of the boundary of the urban district of Monaghan.

( h ) The Killyconigan Road for a distance of 45 metres from its junction with the Monaghan-Clones road (National Road N54).

( i ) The Rossmore Park Road for a distance of 230 metres from its junction with the Newbliss Road.

( j ) The Cootehill Road for a distance of 236 metres from the boundary of the urban district of Monaghan.

( k ) The Emyvale Road (National Road N2) between a point 450 metres south of the boundary of the urban district of Monaghan and a point 145 metres north of the said boundary.

8. The following roads at Milltown:--

( a ) The Monaghan Road for a distance of 300 metres from its junction with the Blackwater Vale Road.

( b ) The Drumgoask Road for a distance of 500 metres from its junction with the Blackwater Vale Road.

( c ) The Blackwater Vale Road for a distance of 200 metres from its junction with the Monaghan Drumgoask road.

( d ) The Telaydan Road for a distance of 50 metres from its junction with the Blackwater Vale Road.

EXPLANATORY NOTE.

These regulations replace the Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1988 ( S.I. No. 119 of 1988 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, Fire Brigade vehicles and Garda Síochána vehicles being used in the course of duty are exempted from all speed limits by the Regulations.
