SOCIAL WELFARE (EMPLOYMENT BY A PRESCRIBED RELATIVE) (AMENDMENT) REGULATIONS, 1994.

SOCIAL WELFARE (EMPLOYMENT BY A PRESCRIBED RELATIVE) (AMENDMENT) REGULATIONS, 1994.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 4 and paragraph 3 of Part II of the First Schedule of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993), hereby makes the following Regulations:

Citation and construction.

1. (1) These Regulations may be cited as the Social Welfare (Employment by a Prescribed Relative) (Amendment) Regulations, 1994.

(2) These Regulations and the Social Welfare (Employment by a Prescribed Relative) Regulations, 1953 ( S.I. No. 19 of 1953 ) shall be construed together as one and may be cited together as the Social Welfare (Employment by a Prescribed Relative) Regulations, 1953 to 1994.

Prescribed relatives.

2. Article 2 of the Social Welfare (Employment by a Prescribed Relative) Regulations, 1953 ( S.I. No. 19 of 1953 ) is hereby amended by the insertion after "halfsister of the employed person" of "(other than in a case where any such relative is a ward of court within the meaning of Order 67 of the Rules of the Superior Courts ( S.I. No. 15 of 1986 ))".

EXPLANATORY NOTE.

Employment by a prescribed relative being either employment in the common home of the employer and the employed person (or employment specified by Regulations as corresponding to employment in the common home of the employer and the employed person) is not insurable.

These Regulations exempt from this provision, employment by a prescribed relative who is a ward of court.
