COUNTY OF LOUTH TRAFFIC AND PARKING TEMPORARY RULES, 1995.

I, PATRICK J. CULLIGAN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by sections 89 and 90 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968)) of the Road Traffic Act, 1961 (No. 24 of 1961), the Local Government (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 269 of 1977 ), with the consent of the Minister for the Environment, hereby make the following temporary rules in respect of the area comprising the administrative county of Louth including the borough of Drogheda, the urban district of Dundalk and the town of Ardee:

Citation.

1. These Rules may be cited as the County of Louth Traffic and Parking Temporary Rules, 1994.

Commencement.

2. These Rules shall come into operation on the 8th day of February, 1995.

Definitions.

3. In these Rules--

"disabled drivers parking bay" has the meaning assigned to it by Article 2 of the Regulations of 1992 and shall be indicated by means of--

( a ) the roadway markings of the type provided for in Section B as amended by Article 5 of the Regulations of 1992 of Part VIII (inserted by Article 5 (f) of the Road Traffic (Signs) (Amendment) Regulations, 1964 ( S.I. No. 56 of 1964 )), and

( b ) a symbol, the dimensions and design of which shall be as provided for in Section C (Inserted by Article 6 (b) of the Regulations of 1992) of the said Part VIII;

"the Principal Regulations" means the Road Traffic (Signs) Regulations, 1962 ( S.I. No. 171 of 1962 );

"the Regulations of 1992" means the Road Traffic (Signs) (Amendment) Regulations, 1992 ( S.I. No. 183 of 1992 ).

Area of application.

4. These Rules shall apply to the area comprising the administrative county of Louth, including the borough of application Drogheda, the urban district of Dundalk and the town of Ardee.

Prohibition on stopping or parking outside school entrances.

5. The stopping or parking of a vehicle is hereby prohibited on a part of a roadway along which roadway markings of the type authorised and described in Article 12 (w) and Section D (inserted by the Regulations of 1992) of the Principal Regulations are provided.

Disabled drivers parking bays.

6. It is hereby prohibited to park a vehicle, other than a mechanically propelled vehicle displaying a permit granted to a disabled person in accordance with Bye-law 30 (2) of the County of Louth Traffic and Parking Bye-Laws, 1986 ( S.I. No. 191 of 1986 ), in a disabled drivers parking bay.

Non-application.

7. Notwithstanding Rules 5 and 6, these Rules shall not apply to--

( a ) a vehicle being used in connection with the removal of an obstruction to traffic, the maintenance, improvement or reconstruction of a public road, the provision, alteration or repair of a sewer or of a main, drain, pipe or apparatus for the supply of gas, water or electricity or of a telegraph or telephone line, or the provision of a traffic sign,

( b ) a fire brigade vehicle, an ambulance, or a vehicle being used by a member of the Garda Síochána in the performance of his duties as such member, or

( c ) a vehicle which has either been damaged in an accident or, having had a breakdown, has been parked while such repairs as will enable it to be removed are carried out on it.

EXPLANATORY NOTE.

These Temporary Rules provide for a prohibition on the parking or stopping of vehicles outside school entrances and for the provision of reserved on street parking bays for disabled drivers in the County of Louth.
