ROAD TRAFFIC (CONSTRUCTION, EQUIPMENT AND USE OF VEHICLES) (AMENDMENT) (NO. 2) REGULATIONS, 1996.

ROAD TRAFFIC (CONSTRUCTION, EQUIPMENT AND USE OF VEHICLES) (AMENDMENT) (NO. 2) REGULATIONS, 1996.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 11 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:--

1. (1) These Regulations may be cited as the Road Traffic (Construction, Equipment and Use of Vehicles) (Amendment) (No. 2) Regulations, 1996.

(2) The Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 to 1996 and these Regulations shall be construed as one and may be cited together as the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 to 1996.

2. In these Regulations:--

"the Principal Regulations" means the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 ( S.I. No. 190 of 1963 ).

3. Sub-article (15) of article 11 of the Principal Regulations is hereby amended by the substitution for the said sub-article of the following sub-article:--

"(15) (a) Subject to the provisions of paragraphs (b) and (c) of this sub-article, the maximum overall height of a vehicle, or of a trailer attached to a vehicle, including any load carried on the vehicle or trailer shall not exceed 4.25 metres;

( b ) The maximum overall height of a double deck large public service vehicle shall not exceed 4.57 metres;

( c ) The provisions of paragraph (a) of this sub-article shall not apply, until the 31st day of March, 2001, to

(i) a vehicle, not being an articulated vehicle, registered on or before the 31st day of March, 1991;

(ii) an articulated vehicle, the drawn component of which was first licensed on or before the 31st day of March, 1991;

(iii) a trailer first licensed on or before the 31st day of March, 1991; or

(iv) a trailer first licensed on or after the 1st day of April, 1991, being towed by a vehicle referred to in sub-paragraph (i) of this paragraph, which, including any load carried thereon, exceeds a height of 4.25 metres provided that the overall height of the trailer, including any load carried thereon, does not exceed the overall height of the vehicle by which it is being towed, including any load carried on such vehicle.".

EXPLANATORY NOTE.

These Regulations extend by 5 years the transitional period for certain older vehicles and trailers (including loads) to comply with the maximum height limit of 4.25 metres.
