EXPLOSIVES ACT, 1875 (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1997 |

The Government, in exercise of the powers conferred on them by section 6 (1) of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), hereby order as follows: |
||
1. This Order may be cited as the Explosives Act, 1875 (Transfer of Departmental Administration and Ministerial Functions) Order, 1997. |
||
2. In this Order |
||
"the Act of 1875" means the Explosives Act, 1875; |
||
"functions" includes powers and duties. |
||
3. The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 4 of this Order are hereby transferred to the Department of Justice. |
||
4. There are hereby transferred to the Minister for Justice |
||
( a ) the functions vested in the Minister for Transport, Energy and Communications under section 34 of the Act of 1875 in relation to the sanctioning of bye-laws to be made by every harbour authority (within the meaning of that Act) for regulating the conveyance, loading and unloading of gunpowder, and |
||
( b ) the functions vested in the Minister for Transport, Energy and Communications by virtue of section 39 of the Act of 1875 in relation to the sanctioning of bye-laws to be made by every harbour authority (within the meaning of that Act) for regulating the conveyance, loading and unloading of explosives other than gunpowder. |
||
