EXPLOSIVES ACT, 1875 (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1997

EXPLOSIVES ACT, 1875 (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1997

The Government, in exercise of the powers conferred on them by section 6 (1) of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), hereby order as follows:

1. This Order may be cited as the Explosives Act, 1875 (Transfer of Departmental Administration and Ministerial Functions) Order, 1997.

2. In this Order

"the Act of 1875" means the Explosives Act, 1875;

"functions" includes powers and duties.

3. The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 4 of this Order are hereby transferred to the Department of Justice.

4. There are hereby transferred to the Minister for Justice

( a ) the functions vested in the Minister for Transport, Energy and Communications under section 34 of the Act of 1875 in relation to the sanctioning of bye-laws to be made by every harbour authority (within the meaning of that Act) for regulating the conveyance, loading and unloading of gunpowder, and

( b ) the functions vested in the Minister for Transport, Energy and Communications by virtue of section 39 of the Act of 1875 in relation to the sanctioning of bye-laws to be made by every harbour authority (within the meaning of that Act) for regulating the conveyance, loading and unloading of explosives other than gunpowder.
