S.I. No. 396/1998:

TELECOMMUNICATIONS (AMENDMENT) (NO. 8) SCHEME, 1998.

TELECOMMUNICATIONS (AMENDMENT) (NO. 8) SCHEME, 1998.

Bord Telecom Eireann plc, in exercise of the powers conferred on it by section 90 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme.

1. This Scheme may be cited as the Telecommunications (Amendment) (No. 8) Scheme, 1998.

2. (1) The collective citation "the Telecommunications Schemes, 1994 to 1998" includes this Scheme.

(2) Article 4(a) and Article 4 (c) shall come into operation on 18 December 1998.

(3) Article 4(b), Article 4(d), Article 4(e) and Article 4(f) shall come into operation on 21 October 1998.

(4) Article 4(g) shall be deemed to have come into operation on 1 July 1998.

3. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Scheme.

4. The Telecommunications Scheme, 1994 ( S.I. No. 177 of 1994 ) is hereby amended by:

(a) The addition of the following paragraph (22) to Article 63 thereof:

"63(22)(i) Bord Telecom Eireann plc may provide a facility (in this Scheme referred to as "Caller Display") to Subscribers generally or to such groups of Subscribers as it shall determine whereby the Telephone number of a Subscriber making a Call (the "Calling Party") may be displayed on the Telephone of the Subscriber to whom the Call is made (the "Called Party"). There shall be charged to the Subscriber and paid by him in respect of Caller Display the charge specified in Section 1 of Part 6 of the First Schedule to this Scheme.

63(22)(ii) It shall be a condition of the provision of Caller Display that:

(a) the Called Party is connected to a Telephone Exchange other than an analogue Telephone Exchange connected to the Bord Telecom Eireann plc network or to another network with which Bord Telecom Eireann plc has an agreement to support the provision of Caller Display between the Calling Party network and the Called Party network;

(b) the Call being made by the Calling Party is not an Operator Assisted Call;

(c) the Calling Party is not making the Call and the Called Party is not receiving the Call on certain payphones or switchboard types;

(c) the Subscriber shall elect to avail of Caller Display generally or on a Call by Call basis and shall inform Bord Telecom Eireann plc of its election;

(d) the Called Party must receive the Call by using a Telephone which is capable of providing Caller Display."

(b) the substitution of the following Part 3 of the First Schedule for Part 3 of the First Schedule thereto:

"PART 3

{Article 58}  Subscriber Dialled Trunk Calls
