EUROPEAN COMMUNITIES (SECOND GENERAL SYSTEM FOR THE RECOGNITION OF PROFESSIONAL EDUCATION AND TRAINING) (AMENDMENT) REGULATIONS, 1998.

I, MICHEÁL MARTIN, Minister for Education and Science, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive No. 97/38/EC1 of 20 June, 1997, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Second General System for the Recognition of Professional Education and Training) (Amendment) Regulations, 1998.

(2) These Regulations should come into operation on the 14th day of October, 1998.

2. Regulations 2(1) of the European Communities (Second General System for the Recognition of Professional Education and Training) Regulations, 1996 (S.I. No. 135 of 1996), is hereby amended by the substitution for the definition of “the Directive” of the following definition:

“the Directive” means Council Directive No. 92/51/EEC2 of 18 June, 1992 (as amended by Commission Directive No. 94/38/EC3 of 26 July, 1994, Commission Directive No. 95/43/EC4 of 20 July, 1995, and Commission Directive No. 97/38/EC1 of 20 June, 1997);

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The purpose of these regulations is to give legal effect to Council Directive 97/38/EC which provides for the amendment of Annex C to Council Directive 92/51/EC which is essentially a list of courses which have a special structure as outlined in Article I (a) (ii) of that Directive. Directive 92/51/EC provides for the mutual recognition of sub-degree level qualifications such as diplomas and certificates across the Community. Council Directive 97/38/EC deletes three UK training courses from those listed in Annex C.
