Wildlife (Import and Export of Fauna and Flora) (Designation of Ports and Airports) Regulations, 2001

I, SÍLE DE VALERA, Minister for Arts, Heritage, Gaeltacht and the Islands, in exercise of the powers conferred on me by subsection (1A) (inserted by section 56(b) of the section 52 of the Wildlife Act, 1976 ( No. 39 of 1976 ), and subsection (1A) (inserted by section 57(b) of section 53 of the Wildlife Act, 1976 ( No. 39 of 1976 ), make the following Regulations:

1.       These Regulations may be cited as the Wildlife (Import and Export of Fauna and Flora) (Designation of Ports and Airports) Regulations, 2001.

2.       (1)     In these Regulations -

“Principal Act” means Wildlife Act, 1976 ( No. 39 of 1976 );

“Act of 2000” means Wildlife (Amendment) Act, 2000 ( No. 38 of 2000 ).

(2)     In these Regulations, a reference to a Regulation is a reference to a Regulation of these Regulations.

3.       (1)     Cork Port and Dublin Port are designated for the purposes of -

(a)      paragraph (a) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (a) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act,

in respect of all species of plants and the flowers, roots, seeds or spores of such plants.

(2)     Subject to Regulation 4, Cork Port and Dublin Port are designated for the purposes of -

(a)      paragraph (b) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (b) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act.

4.       The following places only are designated for the purposes of -

(a)      paragraph (b) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (b) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act,

in respect of any part, product or derivative of a plant of a species that constitutes timber -

Cork Port

Drogheda Port

Dublin Port

Foynes Port

Greenore Port

Limerick Port

Wicklow Port.

5.       Dublin Airport is designated for the purposes of -

(a)      paragraph (a) and, subject to Regulation 4, paragraph (b) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (a) and, subject to Regulation 4, paragraph (b) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act.

6.       (1)     Shannon Airport is designated for the purposes of -

(a)      paragraph (a) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (a) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act,

in respect of all species of plants and the flowers, roots, seeds or spores of such plants.

(2)     Subject to Regulation 4, Shannon Airport is designated for the purposes of -

(a)      paragraph (b) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (b) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act.

7.       (1)     Cork Airport is designated for the purposes of -

(a)      paragraph (a) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (a) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act,

in respect of all species of plants and the flowers, roots, seeds or spores of such plants.

(2)      Subject to Regulation 4, Cork Airport is designated for the purposes of -

(a)      paragraph (b) of subsection (1A) (inserted by section 56(b) of the Act of 2000) of section 52 of the Principal Act, and

(b)      paragraph (b) of subsection (1A) (inserted by section 57(b) of the Act of 2000) of section 53 of the Principal Act,

in respect of any part, product or derivative of all species of plants, flowers, roots, seeds or spores of such plants.

8.       In the case to which paragraph 1 of Article 12 of Council Regulation (EC) No 338/97 of 9 December 19961 on the protection of species of wild fauna and flora by regulating trade therein relates, the following places are intended to deal with live specimens (within the meaning of that Regulation):

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations designate Ports and Airports of Entry and Exit for Trade with Third Countries in CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora) specimens.
