EUROPEAN COMMUNITIES (RESTRICTIVE MEASURES) (LIBERIA) (AMENDMENT) REGULATIONS 2007

I, MICHE�L MARTIN, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Regulation (EC) No. 234/2004 of 10 February 2004 1 , as amended by Council Regulation (EC) No. 1819/2006 of 11 December 2006 2 , Council Regulation (EC) No. 719/2007 of 25 June 2007 3 and Council Regulation (EC) No. 886/2007 of 23 July 2007 4 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Restrictive Measures) (Liberia) (Amendment) Regulations 2007.

2. The European Communities (Restrictive Measures) (Liberia) Regulations 2004 ( S.I. No. 160 of 2004 ) are amended by substituting for Regulation 2 the following Regulations:

�2. In these Regulations �Council Regulation� means Council Regulation (EC) No. 234/2004 of 10 February 20041, as amended by Council Regulation (EC) No. 1819/2006 of 11 December 20062, Council Regulation (EC) No. 719/2007 of 25 June 20073 and Council Regulation (EC) No. 886/2007 of 23 July 20074.

2A. A person who contravenes Article 2 of the Council Regulation is guilty of an offence.

2B. Where an authorisation has, pursuant to Article 3 or 4 of the Council Regulation, been granted to provide assistance as specified in one or both of those Articles, a person who provides such assistance otherwise than in accordance with the authorisation is guilty of an offence.

2C. A person who is guilty of an offence under these Regulations is liable-

(a) on summary conviction, to a fine not exceeding �5,000 or imprisonment for a term not exceeding 6 months or both, or

(b) on conviction on indictment, to a fine not exceeding �500,000 or imprisonment for a term not exceeding 3 years or both.�.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation).

The effect of this Order is to revoke the part of the European Communities (Restrictive Measures) (Liberia) Regulations 2004 ( S.I. No. 160 of 2004 ) which provides penalties for infringements of Article 6 of Council Regulation (EC) No. 234/2004. The Article concerns a ban on the importation of rough diamonds, round logs and timber products from Liberia.
