CIVIL REGISTRATION (FEES AND ALLOWANCES) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

�Iris Oifigi�il� of 13th November, 2007.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by sections 3, 67 and 67A (inserted by the Civil Registration (Amendment) Act 2005 (No. 19 of 2005)) of the Civil Registration Act 2004 (No. 3 of 2004) hereby make the following regulations:

1. (1) These Regulations may be cited as the Civil Registration (Fees and Allowances) Regulations 2007.

(2) These Regulations come into operation on 5 November 2007.

2. In these Regulations, unless the context otherwise requires-

�Act� means the Civil Registration Act 2004 (No. 3 of 2004) as amended by the Act of 2005;

�Act of 2005� means the Civil Registration (Amendment) Act 2005 (No. 19 of 2005);

�quarter� means each period of 3 consecutive months in a year.

3. For the purposes of section 67A (inserted by the Act of 2005) of the Act-

(a) the amount of �0.86 is prescribed as the fee for registering a birth in the register of births referred to in section 13(1)(a) of the Act,

(b) the amount of �0.86 is prescribed as the fee for registering a stillbirth in the register of stillbirths referred to in section 13(1)(b) of the Act,

(c) the amount of �0.86 is prescribed as the fee for registering a death in the register of deaths referred to in section 13(1)(d) of the Act, and

(d) the amount of �0.86 is prescribed as the fee for registering a marriage in the register of marriages referred to in section 13(1)(e) of the Act.

4. (1) The amount of �172.68 is prescribed as the allowance to be paid, for each year, to a person referred to in section 67A of the Act in relation to the registration of births, still births and deaths.

(2) The amount of �43.17 is prescribed as the allowance to be paid, for each year, to a person referred to in section 67A of the Act in relation to the registration of marriages.

(3) Where an allowance referred to in paragraphs (1) and (2) is to be paid in respect of a part of a year-

(a) in the case of the allowance specified in paragraph (1), the amount of the allowance to be paid in respect of that part of the year shall be an amount that bears the same ratio to the allowance of �172.68 as the part of the year, for which the allowance is to be paid, bears to a year, and

(b) in the case of an allowance specified in paragraph (2), the amount of the allowance to be paid in respect of that part of the year shall be an amount that bears the same ratio to the allowance of �43.17 as the part of the year, for which the allowance is to be paid, bears to a year.

5. (1) A person referred to in section 67A of the Act shall submit an account, in respect of each quarter, in the form set out in the Schedule, to the Superintendent Registrar of the registration area in which that person carries out his or her functions.

(2) A Superintendent Registrar shall consider an account submitted in accordance with paragraph (1) and if he or she is satisfied with the account shall certify the account accordingly and submit the account to the Health Service Executive for payment.

6. Payment, by the Health Service Executive, of fees and allowances under these Regulations, shall be made in respect of a quarter and shall be made on receipt of an account, in the form set out in the Schedule, that has been certified by a Superintendent Registrar.
