EUROPEAN COMMUNITIES (NAMES AND LABELLING OF TEXTILE PRODUCTS) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

I, MICHEÁL MARTIN, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2007/3/EC of 2 February 2007 ¹ hereby make the following regulations-

1. These Regulations may be cited as the European Communities (Names and Labelling of Textile Products) (Amendment) Regulations 2008.

2. In these Regulations, “Principal Regulations” means the European Communities (Names and Labelling of Textile Products) Regulations 1998 ( S.I. No. 245 of 1998 ).

3. Regulation 2 of the Principal Regulations is amended by substituting the following for the definition of “the Directive”:

“the Directive means Directive No. 96/74 of the European Parliament and of the Council of 16 December 1996 ² , as amended by Commission Directive No. 97/37/EC of 19 June 1997 ³ , Commission Directive No. 2004/34/EC of 23 March 2004 ⁴ , Commission Directive 2006/3/EC of 9 January 2006 ⁵ , and Commission Directive 2007/3/EC of 2 February 2007¹;”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be legal interpretation).

This labelling of textiles is governed by the Principal Regulations [ SI No. 245 of 1998 which transposed EU Directive 96/74/EC]. Commission Directive 2007/3/EC amends the Principal Regulations by adding a new textile called “elastolefin”.
