EUROPEAN COMMUNITIES (VEHICLE TESTING) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 8th August, 2008.

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 96/96/EC of 20 December 1996 1 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Vehicle Testing) (Amendment) Regulations 2008.

(2) These Regulations come into operation on 1 January 2009.

2. The European Communities (Vehicle Testing) Regulations 2004 ( S.I. No. 771 of 2004 ) are amended-

(a) in Regulation 2, by substituting for the definition of “first registered” the following:

“ ‘first registered’ means-

(a) the date on which a vehicle is entered in the register established and maintained by the Revenue Commissioners under section 131 of the Finance Act 1992 , or

(b) in the case of a vehicle registered in a jurisdiction outside the State, the date when first registered in accordance with the laws of that jurisdiction or where only the year of first registration of the vehicle is known, that year, in combination with the day and month on which the vehicle was entered in the above register;”

and

(b) in Schedule 2, by substituting for paragraph 3.4 the following:

“3.4 Rear view mirrors and other devices for indirect vision.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations provide that a check for the fitment of additional mirrors and other devices of indirect vision on certain heavy vehicles will form part of the compulsory annual roadworthiness test for these vehicles.
