I, MARY COUGHLAN, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 (as amended by section 2 of the European Communities Act 2007 (No. 18 of 2007)) of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Regulation (EC) No. 423/2007 of 19 April 2007 1 , as amended by Council Regulation (EC) No. 618/2007 of 5 June 2007 2 and Commission Regulation (EC) No. 116/2008 of 28 January 2008 3 , hereby make the following regulations: |

1. These Regulations may be cited as the European Communities (Restrictive Measures) (Iran) (Amendment) Regulations 2008. |
||
2. The European Communities (Restrictive Measures) (Iran) Regulations 2007 ( S.I. No. 616 of 2007 ) are amended- |
||
(a) by substituting the following Regulation for Regulation 2: |
||
“2. In these Regulations ‘Council Regulation’ means Council Regulation (EC) No. 423/2007 of 19 April 20071 as amended by Council Regulation (EC) No. 618/2007 of 5 June 20072 and Commission Regulation (EC) No. 116/2008 of 28 January 20083 .”, and |
||
(b) in Regulation 3 by inserting “3(3),” after “Article 2,”. |

The effect of this Order is to amend the Statutory Instrument that provided for penalties for infringements of Council Regulation (EC) No. 423/2007 of 19 April 2007. The Council Regulation introduced restrictions on the export of goods and technology which could contribute to Iran’s enrichment-related, reprocessing, or heavy water-related activities, or to the development of nuclear weapon delivery systems. It also bans the provision of technical assistance, brokering services and investment related to, and the procurement of, such goods and technology from Iran. The amendments, which give effect to Commission Regulation (EC) No. 116/2008, replace Annexes I and III of the Council Regulation. |
