SOCIAL WELFARE AND PENSIONS ACT 2008 (SECTION 17) (COMMENCEMENT) ORDER 2009

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 4th September, 2009.

I, MARY HANAFIN, Minister for Social and Family Affairs, in exercise of the powers conferred on me by section 1(6) of the Social Welfare and Pensions Act 2008 (No. 2 of 2008), hereby order as follows:

1. This Order may be cited as the Social Welfare and Pensions Act 2008 (Section 17) (Commencement) Order 2009.

2. The 1st day of September 2009 is appointed as the day on which section 17 (other than subsection (5)) of the Social Welfare and Pensions Act 2008 (No. 2 of 2008) shall come into operation on 1st September, 2009.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order provides for the commencement of Section 17 (other than subsection (5)) of the Social Welfare and Pensions Act 2008 .

Section 17 sets out the transitional provisions to allow for the transfer of the administration of the payment of an allowance for the domiciliary care of children from the Department of Health and Children to the Department of Social and Family Affairs.
