DISEASES OF ANIMALS ACT 1966 (FIRST SCHEDULE AND NOTIFICATION) ORDER 2009

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 15th September, 2009.

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by sections 3, 11 and 12 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 2007 (S.I. No. 707 of 2007)), hereby order as follows-

1. This Order may be cited as the Diseases of Animals Act 1966 (First Schedule and Notification) Order 2009.

2. For all the purposes of the Act the Diseases of Animals Act 1966 is amended by the substitution for-

(a) Part I of the First Schedule of-

"PART I

1.Cattle.

2.Goats.

3.Cats and other feline animals.

4.Dogs and other canine animals

5.Horses and all other equine animals.

6.Sheep.

7.All other ruminating animals.

8.Swine.

9.Agoutis, beavers, capybara, chinchillas, ferrets, fitches, guinea pigs, hamsters, hares, hedgehogs, jerboas, lemmings, marmots, martens, mice, mink, moles, mongooses, nutria, porcupines, prairie dogs, raccoon, rabbits, rats, shrews, squirrels, voles, and all other animals of the genus rodentia, insectivora and mustelidae.

10.Animals of a kind, species or order other than those specified at entry nos 1-9 above.

11.the Order Artiodactyla, which order includes the animals commonly known as peccaries, hippopotamuses, camels, llamas, chevrotains, deer, giraffes, pronghorns, antelopes, duikers, and gazelles,

12.the Order Monotremata, which Order includes the animals commonly known as echidnae and duck-billed platypuses,

13.the Order Perissodactyla, which Order includes the animals commonly known as zebras, taipers and rhinoceroses,

14.the Order Pholidata, which Order is comprised of the animals commonly known as pangolins,

15.the Order Probiscidea, which Order is comprised of the animal commonly known as an elephant, and

16.the Order Tubilidentata, which Order is comprised of the animal commonly known as an aardvark.",

8.For the purpose of giving effect to the Diseases of Animals Act 1966 (Control on Animal and Poultry Vaccines) Order 2002 ( S.I. No. 528 of 2002 ), infectious bursal disease (Gumboro disease)

9.Johne's disease in cattle, goats, sheep, other ruminating animals and swine

10. Maedi Visna

11.For the purpose of giving effect to the Diseases of Animals Act 1966 (Monkey pox virus) Order 2003 ( S.I. No. 279 of 2003 ), monkey pox virus

12. Mycoplasmosis (caused by or involving Mycoplasma synovia)

13. Pulmonary adenomatosis

14. Salmonellosis (caused by or involving I or Salmonella typhimurium)

15. Sheep scab

16. Tuberculosis in ruminating animals

3. The Diseases of Animals Act 1966 (Notification and Control of Animal Diseases) Order 2008 ( S.I. No. 101 of 2008 ) is amended-

(a) by the insertion, after Article 4(6), of-

"(7) This Article does not apply in the case of notification of swine influenza.", and

(b) by the substitution for the Schedule, of-

4. The following are revoked:

(a) the Anthrax Order 1930 (S.R. & O. No. 57 of 1930),

(b) the Diseases of Animals Act 1966 (First Schedule) Order 2001 ( S.I. No. 469 of 2001 ), and

(c) the Diseases of Animals Act 1966 (Notification and Control of Animal Diseases) (Amendment) Order 2009 ( S.I. No. 292 of 2009 ).
