FINANCIAL EMERGENCY MEASURES IN THE PUBLIC INTEREST (FARM WASTE MANAGEMENT SCHEME) ORDER 2009 |

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by subsection (1) of section 12 of the Financial Emergency Measures in the Public Interest Act 2009 (No. 5 of 2009) and, having consulted the Minister for Finance, being of the opinion that it is necessary to make this Order having regard to the matters set out in paragraphs (a) and (b) of that subsection, hereby order as follows: |

1. This Order may be cited as the Financial Emergency Measures in the Public Interest (Farm Waste Management Scheme) Order 2009. |
||
2. Any liability, accrual or payment under the Farm Waste Management Scheme, consequent on the approval of an amount in respect of a claim for payment under that Scheme is deferred, and payment shall be made as follows: |
||
(a) in respect of the first 40 per cent of the amount so approved- |
||
(i) on or before 31 December 2009, where that approval was duly given on or before the date of the making of this Order, or |
||
(ii) if that approval was duly given after the date of the making of this Order, on or before 31 December 2010 or, where approval is given within 6 weeks before that date or at a later date, within 6 weeks of that approval, |
||
(b) in respect of the next 40 per cent of the amount so approved, on or before 31 December 2010 or, where approval is given within 6 weeks before that date or at a later date, within 6 weeks of that approval; |
||
(c) in respect of the remaining amount unpaid, on or before 31 December 2011 or, where approval is given within 6 weeks before that date or at a later date, within 6 weeks of that approval. |
