Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 8th April, 2011.

I, ALAN SHATTER, Minister for Justice and Law Reform in exercise of the powers conferred on me by subsections (4) and (6) of section 3 of the Decommissioning Act 1997 (No. 3 of 1997) (as adapted by the Justice, Equality and Law Reform (Alteration of Name of Department and Title of Minister) Order 2010 ( S.I. No. 216 of 2010 )), and after consultation with the Secretary of State for Northern Ireland, hereby order as follows:

1. This Order may be cited as the Independent International Commission on Decommissioning (Dissolution of Commission and Inviolability of Archives) Order 2011.

2. The 31st day of March 2011 is appointed as the day on which the Commission shall stand dissolved.

3. The Decommissioning Act 1997 (Independent International Commission on Decommissioning) (Privileges and Immunities) Order 1997 ( S.I. No. 399 of 1997 ) is amended-

(a) in Article 4, by inserting "Articles 5 and 6 and" after "subject to", and

(b) by substituting the following for Article 5:

"5.The archives of the Commission shall be inviolable until 31 March 2041.

6. Notwithstanding Article 5, the Minister may, where he or she is satisfied that it is in the public interest to do so, and with the agreement of the Secretary of State, waive the inviolability, conferred by this Order, of all or part of the archives of the Commission, for a specified period or indefinitely, and for a particular purpose or generally.".
