I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Directive 2009/103/EC of the European Parliament and of the Council of 16 September 2009¹ , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Motor Insurance) (Limitation of Insurance in relation to Injury to Property) Regulations 2011.

2. Section 56(2)(inserted by Regulation 3(1) of the European Communities (Road Traffic)(Compulsory Insurance)(Amendment) Regulations 1995 ( S.I. No. 353 of 1995 )) of the Road Traffic Act 1961 (No. 24 of 1961) by substituting for paragraph (a) (inserted by Regulation 2(b) of the European Communities (Motor Insurance) Regulations 2008 ( S.I. No. 248 of 2008 )) the following:

"(a) it may, in so far as it relates to injury to property, be limited to the sum of €1,120,000 per claim, whatever the number of victims,".

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations give legal effect to the provisions of Directive 2009/103/EC of the 16 September 2009 relating to insurance against civil liability in respect of the use of motor vehicles and the enforcement of the obligation to insure against such liability.

They also provide for the limit per claim for property damage being €1,120,000 regardless of the number of victims.
