S.I. No. 735/2011 - Thoroughbred Foal Levy Regulations 2011.

Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 20th January, 2012.

Horse Racing Ireland, in exercise of the powers conferred on it by section 38A (inserted by section 5 of the Horse and Greyhound Racing (Betting Charges and Levies) Act 1999 (No. 24 of 1999)) of the Irish Horseracing Industry Act 1994 (No. 18 of 1994) and the Horse and Greyhound Racing (Transfer of Departmental Administration and Ministerial Functions) Order 2010 (S. I. No. 179 of 2010) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 (S.I. No. 455/2011)), with the consent of the Minister for Agriculture, Food and the Marine, hereby make the following regulations:

1. (1) These Regulations may be cited as the Thoroughbred Foal Levy Regulations 2011.

(2) These Regulations come into operation on 1 January 2012.

2. In these Regulations-

"advertised value of the nomination fee" means the value of the nomination fee for a particular stallion which is deemed by HRI, following consultation with the owner of the stallion, as being generally applicable for a covering of a mare by that stallion on 15 February in the year prior to the year of birth of the foal by that stallion;

"registered stallion" means a stallion registered as breeding stock with Weatherbys in the stud book for the year prior to the year of birth of the foal by that stallion as advised to HRI by Weatherbys;

"Weatherbys" means Weatherbys Ireland GSB Limited.

3. The owner shall pay a levy for and on behalf of HRI to Weatherbys on application to register a foal in the stud book-

(a) where the foal's sire is a registered stallion, at the rate specified in column (3) opposite the advertised value of the nomination fee of the stallion mentioned in column (1) and the rate band mentioned in column (2) of the Table to this Regulation, or

(b) where the foal's sire is not a registered stallion, at the rate of €250.

4. The Thoroughbred Foal Levy Regulations 2007 ( S.I. No. 853 of 2007 ) are revoked.

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations give effect to a revised fee structure for the Thoroughbred Foal Levy from 1st January 2012. This Levy is payable by owners of thoroughbred foals to Weatherbys Ireland GSB Ltd. on application to register a foal in the stud-book.
