I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 1 (2) of the Safety, Health and Welfare at Work Act 2005 (No. 10 of 2005) (as adapted by the Enterprise, Trade and Innovation (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 245 of 2011 ) and after consultation with the Health and Safety Authority, hereby order as follows: |

1. This Order may be cited as the Safety, Health and Welfare at Work Act 2005 (Commencement) Order 2012. |
||
2. The 1st day of January 2013 is appointed as the day on which section 4(2), insofar as it relates to the following existing enactments comes into operation: |
||
(a) the Boiler Explosions Act 1882, |
||
(b) the Boiler Explosions Act 1890, and |
||
(c) sections 40 , 41 , 42 and 43 of the Factories Act 1955 . |

EXPLANATORY NOTE |
||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) |
||
The purpose of this Order is to activate the repeal as provided for in section 4 (2) of the Safety, Health and Welfare at Work Act 2005 (No. 10 of 2005) in as much as it relates to the following Acts: |
||
(a) the Boiler Explosions Act 1882, |
||
(b) the Boiler Explosions Act 1890, and |
||
(c) sections 40 , 41 , 42 and 43 of the Factories Act 1955 . |
||
This Order shall come into operation from 1st January 2013. |
