I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 20 of, and paragraph 5(5) of the Schedule to, the Milk (Regulation of Supply) Act, 1994 (No. 25 of 1994) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), hereby make the following Regulations: |

1. These Regulations may be cited as the National Milk Agency (Conduct of Elections) (Amendment) Regulations 2012. |
||
2. The National Milk Agency (Conduct of Elections) Regulations 1997 (S. I. No. 185 of 1997) are amended by substituting |
||
(a) Regulation 4(2), of- |
||
"(2)(a) The registered producers who, on the first day of the month next preceding the month in which the election day falls, were suppliers of raw milk for heat treatment for liquid consumption with- |
||
(i) Connacht Gold Co-operative Society Ltd., |
||
(ii) Glanbia Foods Society Ltd., |
||
(iii) Glenisk Ltd., |
||
(iv) Glenveagh Agricultural Co-operative Society Ltd., or |
||
(v) Town of Monaghan Co-operative Agricultural & Dairy Society Ltd. |
||
comprise a constituency and are entitled to elect 3 producer members to the Board of the National Milk Agency, and |
||
(b) The registered producers who, on the first day of the month next preceding the month in which the election day falls, were suppliers of raw milk for heat treatment for liquid consumption with- |
||
(i) Adare Farm |
||
(ii) Arrabawn Co-operative Society Ltd., |
||
(iii) Ardrahan Dairy Products Ltd., |
||
(iv) Centenary Thurles Co-operative Society Ltd., |
||
(v) Clona Dairy Products Society Ltd., |
||
(vi) Dairygold Co-operative Society Ltd., |
||
(vii) Dairygold Co-operative Society Limited as agent for Glanbia Plc, |
||
(viii) Dawn Dairies Ltd., |
||
(ix) Lee Strand Co-operative Creamery Ltd., |
||
(x) North Cork Co-operative Creameries Ltd., |
||
(xi) Valentia Island Farmhouse Dairy, or |
||
(xii) Wexford Creamery Ltd. |
||
comprise a constituency and are entitled to elect 2 producer members to the Board of the National Milk Agency.", and |
||
(b) Regulation 28(1), for the following- |
||
"(28) (1) At the hour of 2pm, or as soon as may be thereafter, on the day next following the day fixed by the Returning Officer for the close of the poll and at the office of the Agency, the Returning Officer shall, in the presence of the candidates agents, open the ballot boxes.". |
