I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to the provisions of European Parliament and Council Directive 2002/96/EC1 amended by European Parliament and Council Directive 2003/108/EC2 of 8 December 2003 and by Article 5 of Directive 2008/112/EC3 of the European Parliament and of the Council of 16 December 2008 amending Council Directives 76/768/EEC4 , 88/378/EEC5 , 1999/13/EC6 and Directives 2000/53/EC7 , 2002/96/EC8 and 2004/42/EC9 of the European Parliament and of the Council in order to adapt them to Regulation (EC) No. 1272/200810 , hereby make the following Regulations: |

Citation. |
||
1. These Regulations may be cited as the European Union (Waste Electrical and Electronic Equipment) (Amendment) Regulations 2013. |
||
Commencement. |
||
2. These Regulations shall come into operation on the day after the date on which notice of their making is published in Iris Oifigiúl. |
||
Interpretation. |
||
3. (1) In these Regulations, “Principal Regulations” means the European Communities (Waste Electrical and Electronic Equipment) Regulations 2011 ( S.I. No. 355 of 2011 ), as amended by the European Communities (Waste Electrical and Electronic Equipment) (Amendment) Regulations 2011 ( S.I. No. 397 of 2011 ). |

Amendment of Article 39 of the Principal Regulations. |
||
4. Article 39 of the Principal Regulations is amended by inserting the following after sub-article (6): |
||
“(7) Any person who contravenes or fails to comply with a provision, or provisions, of these Regulations shall be guilty of an offence.” |
||

EXPLANATORY NOTE |
||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) |
||
These Regulations amend the European Communities (Waste Electrical and Electronic Equipment) Regulations 2011 and give further effect to the provisions of European Parliament and Council Directive 2002/96/EC as amended. They are designed to promote the recovery of waste electrical and electronic equipment and to facilitate the achievement of targets for the collection, treatment, recovery and disposal of waste electrical and electronic equipment established by Directive 2002/96/EC as amended. |
