I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by sections 3 and 4 of the Control of Exports Act 2008 (No. 1 of 2008) and for the purposes of giving further effect to Council Regulation (EC) No 428/2009 of 5 May 20091 and of giving effect to Regulation (EU) No 1232/2011 of the European Parliament and of the Council of 16 November 20112 and Regulation (EU) No 388/2012 of the European Parliament and of the Council of 19 April 20123 , hereby order as follows:

1. This Order may be cited as the Control of Exports (Dual Use Items) (Amendment) Order 2013.

2. Article 2 of the Control of Exports (Dual Use Items) Order 2009 ( S.I. No. 443 of 2009 ) is amended, in paragraph (1), by the substitution of the following definition for the definition of “Council Regulation”:

“ ‘Council Regulation’ means Council Regulation (EC) No 428/2009 of 5 May 2009, as amended by Regulation (EU) No 1232/2011 of the European Parliament and of the Council of 16 November 2011 and Regulation (EU) No 388/2012 of the European Parliament and of the Council of 19 April 2012.”.

EXPLANATORY NOTE

The purpose of this Order, which was made further to sections 3 and 4 of the Control of Exports Act 2008 , is to give further effect to Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items and gives effect to Regulation (EU) No 1232/2011 of the European Parliament and of the Council and Regulation (EU) No 388/2012 of the European Parliament and of the Council.

The Order gives effect to five new EU General Export Authorisations called “Union General Export Authorisations”. These Authorisations provide for export of certain goods to certain countries of destination where certain conditions and requirements are met as outlined in Regulation (EU) No 1232/2011.

The Order also gives effect to Regulation (EU) No 388/2012 which amends the list of dual-use products covered by Annex I of Council Regulation (EC) No 428/2009.
