Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 27th December, 2013.

I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 7 and 39 of the Waste Management Act 1996 , hereby make the following regulations:

Citation

1. These Regulations may be cited as the Waste Management (Prohibition of Waste Disposal by Burning) (Amendment) Regulations 2013.

Interpretation

2. "Principal Regulations" means the Waste Management (Prohibition of Waste Disposal by Burning) Regulations 2009 (S.I. 286 of 2009).

Amendment of the Principal Regulations

3. The Principal Regulations are amended by substituting for Regulation 6 the following:

" Cessation of the permissible disposal of waste by burning

6. The burning of waste in compliance with Regulation 5(1)(a) and 5(1)(b) shall cease on 1 January 2016.".

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The purpose of these regulations is to extend until 1 January, 2016 an exemption provided for under the Waste Management (Prohibition of Waste Disposal by Burning) Regulations 2009 (S.I. 286 of 2009) which exists to allow farmers, as a last resort, to dispose of wastes generated by agricultural practices.
