Notice of the making of this Statutory Instrument was published in

I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Delegated Regulation (EU) No 492/2014 of 7 March 2014¹ and Regulation (EU) No 334/2014 of the European Parliament and of the Council of 11 March 2014² , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Biocidal Products) (Amendment) Regulations 2014.

2. The European Union (Biocidal Products) Regulations 2013 ( S.I. No. 427 of 2013 ) are amended-

(a) by substituting in Regulation 2(1) for the definition of "Biocidal Products Regulation" the following-

" ‘Biocidal Products Regulation’ means Regulation (EC) No 528/2012 of the European Parliament and of the Council of 22 May 2012³ as amended by Commission Implementing Regulation (EU) No 354/2013 of 18 April 2013⁴ , Commission Implementing Regulation (EU) No 414/2013 of 6 May 2013⁵ , Commission Delegated Regulation (EU) No 736/2013 of 17 May 2013⁶ , Commission Implementing Regulation (EU) No 564/2013 of 18 June 2013⁷ , Commission Delegated Regulation (EU) No 837/2013 of 25 June 2013⁸ and Regulation (EU) No 334/2014 of the European Parliament and of the Council of 11 March 2014 and supplemented by Commission Delegated Regulation (EU) No 492/2014 of 7 March 2014;", and

(b) by substituting for Regulation 4 (2) the following-

"(2) A person seeking an authorisation to place on the market, make available or use a biocidal product under Chapter IV, V, VI or VII shall apply in a format determined in accordance with Article 79 of the Biocidal Products Regulation, as supplemented by Commission Delegated Regulation (EU) No 492/2014 of 7 March 2014, with the appropriate fees as determined under Regulation 25.".

These Regulations revise and update the requirements set down in Regulation (EC) 528/2012 regarding access to the market and renewal of authorisations of biocidal products through an amendment to SI 427 of 2013.
