Notice of the making of this Statutory Instrument was published in

"Iris Oifigiúil" of 9th September, 2014.

I, PASCHAL DONOHOE, Minister for Transport, Tourism and Sport in exercise of the powers conferred on me by section 8 of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012), hereby make the following regulations:

1. These Regulations may be cited as the Commercial Vehicle Roadworthiness (Vehicle Licensing) Regulations 2014.

2. These Regulations shall come into operation on 4th September 2014.

3. In these Regulations-

"Act of 1952" means the Finance (Excise Duties) (Vehicles) Act 1952 (No. 24 of 1952);

"licence" means a licence issued for a vehicle under section 1 of the Act of 1952;

"licensing authority" means:

- a city council, a county council or a city and county council (within the meaning of the Local Government Act 2001 (No. 37 of 2001)) which grants licences under section 1 of the Act of 1952, and

- the Minister for Transport, Tourism and Sport; and

"Regulations of 2013" means the Commercial Vehicle Roadworthiness (Vehicle Testing) (No. 2) Regulations 2013 ( S.I. No. 347 of 2013 ).

3. A licensing authority shall refuse to issue a licence for a vehicle to which the Regulations of 2013 apply unless a certificate of roadworthiness is in force in respect of the vehicle on the day on which the licence comes into operation.

4. For the purposes of Regulation 3, a licensing authority may request that the certificate of roadworthiness be produced.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations require persons applying for a licence under section 1 of the Finance (Excise Duties) (Vehicles) Act 1952 in respect of a CVR vehicle to have a certificate of roadworthiness which is in force in respect of the vehicle on the day on which the licence comes into operation.
