The Irish Aviation Authority, in exercise of the powers conferred on it by sections 5 , 58 , 59 , 60 , 60 (1)(j)(i) of the Irish Aviation Authority Act, 1993 , (No. 29 of 1993) as amended by the Air Navigation and Transport (Amendment) Acts, 1998 (No. 24 of 1998) and the Aviation Regulation Act, 2001 (No. 1 of 2001) hereby orders as follows: |
||||||||
1. This order may be cited as the Irish Aviation Authority Fees Order, 2015. |
||||||||
2. This Order shall come into operation on the first day of January, 2016. |
||||||||
3. The Irish Aviation Authority (Fees) Order 2007, ( S.I. No. 805 of 2007 ) is hereby revoked with effect from the coming into operation of this Order. |
||||||||
4. The Authority may require that a fee in respect of a Schedule to this Order shall be remitted to the Authority prior to issue or renewal of the certificate, licence, approval or authorisation concerned or prior to the undertaking of an examination or test subject to a fee under that Schedule. |
||||||||
5. The Authority may suspend a licence, certificate, approval or authorisation in respect of which a fee required by a Schedule to this Order has not been remitted to the Authority by the holder. A licence, certificate, approval or authorisation which is suspended by the Authority shall not be in force in respect of the person, aircraft or organisation to which it relates unless and until it is re-instated by the Authority. |
||||||||
6. The Authority, through such of its officers as may be so authorised in that behalf, may remit or reduce, in any case or class of cases in relation to which it is satisfied that it is reasonable to do so, any fee prescribed by this Order. |
||||||||
7. The Authority may give such directions in respect of such matters and things as may be specified in this Order for carrying out the purposes of this Order or the Schedules thereto as may be necessary and appropriate. |
||||||||
8. Directions under this Order may be given in the form of Aeronautical Notice, Aeronautical Information Circular, or by Notice sent by registered post to the person affected. |
||||||||
9. The fee scales in this Order are specified in Euro. |
||||||||
10. In this order: |
||||||||
"the Authority" means the Irish Aviation Authority and references to the charging and levying of fees shall be construed as references to the charging and levying of fees by the Authority; |
||||||||
"ARC" means airworthiness review certificate as detailed in the EU Commission Regulation, Part M, Subpart I - Airworthiness Review Certificate; |
||||||||
"CAMO" means Continuing Airworthiness Management Organisation as detailed in the EU Commission Regulation, Part M, Subpart G - Continuing Airworthiness Management Organisation; |
||||||||
"complex motor-powered aircraft" as defined in Regulation (EC) No 216/2008, shall mean: |
||||||||
(i) an aeroplane: |
||||||||
- with a maximum certificated take-off mass exceeding 5,700 kg, or |
||||||||
- certificated for a maximum passenger seating configuration of more than nineteen, or |
||||||||
- certificated for operation with a minimum crew of at least two pilots, or |
||||||||
- equipped with (a) turbojet engine(s) or more than one turboprop engine, or |
||||||||
(ii) a helicopter certificated: |
||||||||
- for a maximum take-off mass exceeding 3 175 kg, or |
||||||||
- for a maximum passenger seating configuration of more than nine, or |
||||||||
- for operation with a minimum crew of at least two pilots, or |
||||||||
(iii) a tilt rotor aircraft; |
||||||||
"European Aviation Safety Agency" - (abbreviated "EASA") means the Agency established on 28th September 2003 by Regulation (EC)1 No. 1592/2002 of the European Parliament and of the Council of 15th July 2002 (hereinafter referred to as "the EASA Regulation"); |
||||||||
"EASA Regulations" means the EASA Regulation and any regulations made thereunder, including all parts of such regulations and their associated certification specifications as adopted by EASA; |
||||||||
"JAA licence" means a flight crew licence issued in accordance with JAR-FCL for a flight crew member; |
||||||||
"JAR-FCL" means the Joint Aviation Requirements applicable to Flight Crew Licensing; |
||||||||
"Joint Aviation Authorities (abbreviated as JAA)" has the meaning ascribed to it in section 14 (6) of the Act of the Irish Aviation Authority Act, 1993 (No. 29 of 1993) as amended; |
||||||||
"Joint Aviation Requirements (abbreviated as JARs)" means Requirements adopted by the Joint Aviation Authorities and accepted by the State under the terms of the Arrangements defined in section 14 (6) of the Irish Aviation Authority Act, 1993 (No. 29 of 1993) as amended; |
||||||||
"MTWA" the maximum total weight authorised in respect of an aircraft means, for the purposes of this Order, the maximum weight at which that aircraft may legally be operated in accordance with its type certificate or equivalent document or such weight as may be accepted by the Authority as the maximum or reference operating weight in respect of a particular aircraft at the time of its registration; |
||||||||
"PART 66" means that part of the EU Commission Regulations which deals with the licensing of maintenance personnel in the context of the approval of organisations and personnel involved in tasks on the continuing airworthiness of aircraft and aeronautical products; |
||||||||
"PART 145" means that part of the EU Commission Regulations which deals with the approval of maintenance organisations on the continuing airworthiness of aircraft and aeronautical products and on the approval of organisations and personnel involved in these tasks; |
||||||||
"PART 147" means that part of the EU Commission Regulation which deals with the approval of aircraft maintenance engineer training organisations in the context of the approval of organisations and personnel involved in tasks on the continuing airworthiness of aircraft and aeronautical products; |
||||||||
"PART M Subpart G" means that part of the EU Commission Regulation which deals with the approval of Continuing Airworthiness Management Organisations in the context of the approval of organisations and personnel involved in tasks on the continuing airworthiness of aircraft and aeronautical products; |
||||||||
"PART M Subpart F" means that part of the EU Commission Regulation which deals with the approval of certain maintenance organisations in the context of the approval of organisations and personnel involved in tasks on the continuing airworthiness of aircraft and aeronautical products; |
||||||||
"PART CC" means that part of the EU Commission Regulations laying down technical requirements and administrative procedures related to cabin crew, which deals with the issuance of cabin crew attestations; |
||||||||
"PART FCL" means that part of the EU Commission Regulations laying down technical requirements and administrative procedures related to civil aviation aircrew, which deals with the licensing of aircrew including Annexes related to the conversion of existing national licences for the acceptance of licences issued by or on behalf of third countries; |
||||||||
"PART MED" means that part of the EU Commission Regulations laying down technical requirements and administrative procedures related to civil aviation aircrew, which deals with the medical certification of aircrew; |
||||||||
"PART ORA" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to civil aviation aircrew, which relates to organisation requirements; |
||||||||
"PART ORO" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to Air Operations, which relates to organisation requirements; |
||||||||
"PART CAT" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to Air Operations, which relates to commercial Air transport requirements; |
||||||||
"PART SPA" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to Air Operations, which relates to requirements for specific approvals; |
||||||||
"PART NCC" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to Air Operations, which relates to non-commercial air operations with complex motor-powered aircraft requirements; |
||||||||
"PART NCO" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to Air Operations, which relates to non-commercial air operations with other-than-complex motor-powered aircraft requirements; |
||||||||
"PART SPO" means that part of the EU Commission Regulation Regulations laying down technical requirements and administrative procedures related to Air Operations, which relates to specialised operations; |
||||||||
SCHEDULE 1 |
||||||||
FEES FOR THE REGISTRATION OF AN AIRCRAFT ON THE EI REGISTER |
||||||||
(1) There shall be charged and levied for each application for the issue of a certificate of registration of an aircraft including sailplanes and balloons, fees in accordance with the following scale: |
||||||||
where the maximum total authorised weight (MTWA) of the aircraft: |
||||||||
(a) does not exceed 2,730 kg, a fee of €71; |
||||||||
(b) exceeds 2,730 kg but does not exceed 5,700 kg, a fee of €190; |
||||||||
(c) exceeds 5,700 kg but does not exceed 13,600 kg, a fee of €274; |
||||||||
(d) exceeds 13,600 kg but does not exceed 45,500 kg, a fee of €441; |
||||||||
(e) exceeds 45,500 kg, a fee of €656. |
||||||||
(2) There shall be charged and levied for the reservation of an out of sequence certificate of registration of an aircraft, for each period of six months or less, a fee of €267. |
||||||||
(3) There shall be charged and levied for the issue of an out of sequence certificate of registration of an aircraft, in addition to any other fee payable under (1) above, a fee of €710. |
||||||||
(4) There shall be charged and levied in the case of an aircraft which is the subject of a charter by demise or a lease contract or a hire purchase agreement, for the name and address of the charterer, lessor or hirer to be entered in the aircraft register, a fee of €320. |
||||||||
(5) There shall be charged and levied for the copy of an entry on the aircraft register subject to such conditions as the Authority may require, a fee of €91. |
||||||||
(6) There shall be charged and levied for the reissue of a certificate of registration following verification of address change in respect of the aircraft to which it relates a fee equal to 50% of that for issue for the certificate concerned. |
||||||||
(7) Where the applicant for a certificate of registration is a limited company, there may be charged and levied in addition to any other fee payable under paragraphs (1) to (6) above, a fee of €107 in respect of the verification of company registration details with the Companies Registration Office. |
||||||||
(8)(a) Where the applicant withdraws an application for registration before significant administrative working commences on the application, the fees remitted will be returned subject to an administrative charge equal to the relevant registration fee. |
||||||||
(b) Where the applicant withdraws an application following significant administrative work by the Authority, the cost of such work at €208 per hour shall be deducted from any refund. |
||||||||
SCHEDULE 1A |
||||||||
FEES FOR THE REGISTRATION OF AN AIRCRAFT ON THE EJ REGISTER |
||||||||
(1) There shall be charged and levied for each application for the issue of a certificate of registration of an aircraft including sailplanes and balloons, a fee of €656. |
||||||||
(2) There shall be charged and levied for the copy of an entry on the aircraft register subject to such conditions as the Authority may require, a fee of €91. |
||||||||
(3) There shall be charged and levied for the reissue of a certificate of registration following verification of address change in respect of the aircraft to which it relates a fee equal to 50% of that for issue for the certificate concerned. |
||||||||
(4)(a) Where the applicant withdraws an application for registration before significant administrative working commences on the application, the fees remitted will be returned subject to an administrative charge equal to the relevant registration fee; |
||||||||
(b) Where the applicant withdraws an application following significant administrative work by the Authority, the cost of such work at €208 per hour shall be deducted from any refund. |
||||||||
SCHEDULE 2A |
||||||||
EI REGISTERED AIRCRAFT FEES FOR CERTIFICATE OF AIRWORTHINESS |
||||||||
(1) There shall be charged and levied a fee for the issue of a certificate of airworthiness, or the issue of an export certificate of airworthiness, or the issue or renewal of a validation for a certificate of airworthiness, and for each subsequent year or part thereof in which the certificate is in force. The fee should be paid in advance. |
||||||||
(a) in the case of a sailplane/powered sailplane or balloon of which the maximum total weight authorised does not exceed 2,000 kg, a fee of €213. |
||||||||
(b) in the case of an aeroplane of which the maximum total weight authorised: |
||||||||
(i) does not exceed 5,700 kg, for each 50 kg or part thereof, a fee of €12; |
||||||||
(ii) does not exceed 10,000 kg, for each 50 kg or part thereof, a fee of €24; |
||||||||
(iii) exceeds 10,000 kg but does not exceed 200,000 kg, for each 500 kg or part thereof, above 10,000 kg, in addition to the maximum fee payable under (ii) above, a fee of €147; |
||||||||
(iv) exceeds 200,000 kg, for each 500 kg or part thereof, above 200,000 kg, in addition to the maximum fee payable under (iii) above, a fee of €121; |
||||||||
(v) or aircraft exceeding 250,000 kg the fee is limited to that payable for an aircraft of 250,000 kg.; |
||||||||
(vi) maximum fee of €30,000 will apply in the case where the aircraft does not operate while on the Irish Register. This excludes flights for the purpose of demonstration, customer acceptance, ferry or maintenance tasks. |
||||||||
(c) in the case of a rotorcraft of which the maximum total weight authorised: |
||||||||
(i) does not exceed 1,000 kg, a fee of €609; |
||||||||
(ii) exceeds 1,000 kg, but does not exceed 10,000 kg, for each 50 kg or part thereof above 1000 kg, in addition to the maximum fee payable under (i) above, a fee "F(€)" computed according to the following formula: |
||||||||
F(€) = [36 - W/1000] |
||||||||
where "W" is the maximum takeoff weight authorised in kilograms; |
||||||||
(iii) exceeds 10,000 kg for each 500 kg or part thereof, above 10,000 kg, in addition to the maximum fee payable under (ii) above, a fee of €147. |
||||||||
(2) Where an aircraft is based in another state under a lease agreement acceptable to the Authority and operated by an operator who is not the holder of an Air Operator Certificate issued by the Authority, the fees applicable at (i), (ii) and (iii) of paragraph (1) b or (1) c of this Schedule shall be generally applicable to that aircraft but there shall be charged and levied a minimum fee of €10,092 per aircraft for each year to which an issue, renewal or continuance of the certificate relates. |
||||||||
(3) For aircraft below 5,700 kg Maximum Take Off Weight Authorised (MTWA), sailplanes, powered sailplanes and balloons which are not used in Commercial Air Transport and are not classified as a complex motor-powered aircraft: |
||||||||
(a) When a Certificate of Airworthiness is validated by means of an ARC issued or extended by a CAMO the applicable fee shall be reduced to €100, provided the ARC is registered with the Irish Aviation Authority within 10 days of its issue. ARC’s may be registered with the Irish Aviation Authority by sending a copy to [email protected] or by post to Irish Aviation Authority, The Times Building, 11-12 D’Olier Street, Dublin 2. |
||||||||
(b) When a Certificate of Airworthiness is validated by means of an ARC issued by the IAA, with the exception of initial ARC, based on a recommendation, the applicable fee shall be reduced to €100. ARC Recommendations may be issued by a CAMO, or a Part 66 Licence holder (certifying staff) approved specifically by the IAA for the purpose of making ARC recommendations per M.A.901(g). |
||||||||
SCHEDULE 2B |
||||||||
EJ-REGISTERED AIRCRAFT FEES FOR CERTIFICATE OF AIRWORTHINESS |
||||||||
(1) There shall be charged and levied a fee for the issue of a certificate of airworthiness, or the issue of an export certificate of airworthiness, or the issue or renewal of a validation for a certificate of airworthiness, and for each subsequent year or part thereof in which the certificate is in force. The fee should be paid in advance: |
||||||||
(a) In the case of an aeroplane of which the maximum total weight authorised: |
||||||||
(i) does not exceed 12,184 kg, a fee of €10,000; |
||||||||
(ii) exceeds 12,184 kg but does not exceed 200,000 kg, for each 500 kg or part thereof, above 12,184 kg, in addition to the maximum fee payable under (i) above, a fee of €165; |
||||||||
(iii) exceeds 200,000 kg, for each 500 kg or part thereof, above 200,000 kg, in addition to the maximum fee payable under (ii) above, a fee of €143; |
||||||||
(iv) For aircraft exceeding 250,000 kg the fee is limited to that payable for an aircraft of 250,000 kg.; |
||||||||
(v) a maximum fee of €30,000 will apply in the case where the aircraft does not operate while on the Irish Register. This excludes flights for the purpose of demonstration, customer acceptance, ferry or maintenance tasks. |
||||||||
(b) In the case of a rotorcraft of which the maximum total weight authorised: |
||||||||
(i) does not exceed 12,184 kg, a fee of €10,000; |
||||||||
(ii) exceeds 12,184 kg for each 500 kg or part thereof, above 12,184 kg, in addition to the maximum fee payable under (i) above, a fee of €165; |
||||||||
(iii) a maximum fee of €30,000 will apply in the case where the rotorcraft does not operate while on the Irish Register. This excludes flights for the purpose of demonstration, customer acceptance, ferry or maintenance tasks. |
||||||||
SCHEDULE 2C |
||||||||
FEES FOR CERTIFICATE OF AIRWORTHINESS |
||||||||
(1) When a number of aircraft registered in the State are placed on an Air Operator Certificate issued by a state in accordance with ICAO Annex 6, Part 1, the certificate of airworthiness fee due in accordance with Schedule 2A and Schedule 2B of the Fees Order will be reduced in accordance with the following table: |
||||||||
|
||||||||
The reduction in the fee is calculated on the last day of each month and fees falling due the next month are subject to the reduction calculated. |
||||||||
(2) When a number of aircraft registered in the State are placed on an Air Operator Certificate issued by a state in accordance with ICAO Annex 6, Part 1, the export certificate of airworthiness fee due in accordance with Schedule 2A and Schedule 2B of the Fees Order will be reduced in accordance with the following table: |
||||||||

||||||||
The reduction in the fee is calculated on the last day of each month and fees falling due the next month are subject to the reduction calculated. |
||||||||
SCHEDULE 3 |
||||||||
FEES FOR THE DELEGATION OR TRANSFER OF OVERSIGHT UNDER ARTICLE 83 BIS TO THE CHICAGO CONVENTION |
||||||||
(1) When the safety oversight of an aircraft is delegated, or transferred under the provisions of article 83 bis of the Chicago Convention, to an ICAO member state that is not an EU or EASA member state, an annual fee of €51 per 500 kg of the MTWA shall be levied. |
||||||||
For aircraft exceeding 250,000 kg the fee is limited to that payable for an aircraft of 250,000 kg. |
||||||||
The fee shall fall due on the same date as the renewal or continuation date of the certificate of airworthiness fee for the aircraft concerned. |
||||||||
SCHEDULE 4 |
||||||||
FEES FOR A FLIGHT PERMIT |
||||||||
(1) There shall be charged and levied for the grant or renewal of a flight permit, a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority for the purpose of such grant or renewal, subject to a per diem of €1,421 subject to a minimum fee of €330. |
||||||||
(2) For aircraft defined in Annex II to Regulation (EC) 216/2008, as amended, where the Flight Permit is issued as a result of a recommendation made by an organisation holding a Special Approval, on behalf of the registered owner(s), the applicable fee for a Flight Permit is reduced to €100. |
||||||||
SCHEDULE 5 |
||||||||
FEES FOR THE APPROVAL OF A MODIFICATION TO AN AIRCRAFT |
||||||||
(1) There shall be charged and levied for the approval of a modification a charge of €208 per hour subject to the minimum charges set out below. |
||||||||
(a) There shall be charged and levied for approval[3] of a modification to an aircraft less than 2,700 kg a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority for the purposes of such an approval, subject to a minimum fee of €335. |
||||||||
(b) There shall be charged and levied for approval3 of a modification to an aircraft greater than 2,700 kg a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority for the purposes of such an approval, subject to a minimum fee of €1,903 where such modification is not fully supported by a state of manufacturer approval or where the design is not carried out by an EASA approved design organisation. |
||||||||
(c) There shall be charged and levied for approval3 of a modification to an aircraft greater than 2,700 kg a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority for the purposes of such an approval, subject to a minimum fee of €507 where such modification is fully supported by a state of manufacturer approval or where the design is carried out by an EASA approved design organisation. |
||||||||
SCHEDULE 6 |
||||||||
FEES FOR THE ISSUE OF A MAINTENANCE ORGANISATION APPROVAL |
||||||||
(1) There shall be charged and levied by the Authority for the inspection of an organisation for the purposes of the grant, variation, continuation or renewal of its approval, not being a PART 145 or a Part M, Subpart F approval, as an organisation competent to overhaul and to maintain aircraft and aircraft components, a fee of an amount equivalent to the cost of such investigations and work as may be required for the purposes of the inspection, subject to a minimum fee of €1,343. |
||||||||
(2) There shall be charged and levied by the Authority for the conduct of an initial review of a PART M Subpart F maintenance organisation exposition applying for an approval, a fee of €320. |
||||||||
(3) There shall be charged and levied by the Authority a fee for the issue of a PART M Subpart F approval, and for each subsequent year or part thereof in which the approval is in force: |
||||||||
(a) in respect of maintenance of aircraft of maximum take-off weight not exceeding 5,700 kg of aircraft, a fee of €320. |
||||||||
(4) There shall be charged and levied by the Authority for the conduct of an initial review of a PART 145 maintenance exposition of an organisation, applying for an approval, a fee of €325. |
||||||||
(5) There shall be charged and levied by the Authority a fee for the issue of a PART 145 approval, and for each subsequent year or part thereof in which the approval is in force: |
||||||||
(a) in respect of base maintenance of aircraft of maximum take-off weight not exceeding 5,700 kg and line maintenance or inspection (NDI) only of aircraft or engines, a fee of €1,588; |
||||||||
(b) in respect of line and base maintenance of any aircraft exceeding 5700 kg but not exceeding 50,000 kg maximum take-off weight, a fee of €8,449; |
||||||||
(c) in respect of line and base maintenance of aeroplanes of maximum take-off weight exceeding 50,000 kg, a fee of €3,054 per narrow- body servicing bay and €6,412 per widebody bay subject to a minimum overall fee of €9,466; |
||||||||
(d) in respect of the overhaul, reconditioning or major maintenance of gas turbines, a fee of €14,295 in respect of the first engine type for which approval is granted and a fee of €6,268 for each additional engine type subject to a maximum charge of €29,308; |
||||||||
(e) in respect of the overhaul, reconditioning or major maintenance of (aircraft or engine) components or equipment, a fee of €3,917 in the case of a facility at a single location and a fee of €2,740 for each additional facility authorised under the approval; |
||||||||
(f) in respect of any of the above approvals issued as part of a FAR 145 approval for the FAA, under an agreement where surveillance is delegated to the IAA, a fee of €1,279 per annum, in addition to the fees identified above for each approval; |
||||||||
(g) in respect of any of the above approvals issued as part of a TCCA 145 approval for Transport Canada, under an agreement where surveillance is delegated to the IAA, a fee of €1,279 per annum, in addition to the fees identified above for each approval. |
||||||||
(6) There shall be charged and levied by the Authority for the conduct of a full or a partial technical audit of an organisation, referred to in paragraph 5 of this schedule, at any interim period, (i.e. other than at the time of grant of an approval or continuation review audit), a fee of an amount equivalent to the cost of such investigations and work as may be required, reckoned at €1,421 per diem, subject to a minimum charge of €842. This shall include the assessment of an application for a variation of an approval or a capability, subject to a minimum charge of €128. |
||||||||
Note 1: Charges in respect of the annual continuation of a PART 145 approval for base maintenance for the holder of an Irish Air Operator Certificate may, at the discretion of the Authority, be rebated by the value of 25% of the CofA fees paid by that operator |
||||||||
Note 2: Charges in respect of the annual continuation of a PART M, Subpart F approval for a maintenance organisation, that also hold an Irish Part M Subpart G approval may, at the discretion of the Authority, be rebated at a rate of 50% of the Part M, Subpart G fees paid by that organisation. |
||||||||
SCHEDULE 7 |
||||||||
FEES FOR CONTINUING AIRWORTHINESS MANAGEMENT PART M, SUBPART G APPROVAL |
||||||||
(1) There shall be charged and levied by the Authority for the conduct of an initial review of a PART M Subpart G continuing airworthiness management exposition, applying for an approval, a fee of €320. |
||||||||
(2) There shall be charged and levied by the Authority a fee for the issue of a PART M Subpart G approval, and for each subsequent year or part thereof in which the approval is in force: |
||||||||
(a) in respect of continuing airworthiness management of aircraft of maximum take-off weight not exceeding 5,700 kg of aircraft, a fee of €320; |
||||||||
(b) in respect of continuing airworthiness management of aircraft exceeding 5700 kg but not exceeding 50,000 kg maximum take-off weight, a fee of €4,116; |

(c) in respect of continuing airworthiness management of aircraft of maximum take-off weight exceeding 50,000 kg, a fee of €8,324. |

(3) There shall be charged and levied by the Authority a fee for the change of a PART M Subpart G approval in respect of organisations approved per paragraph 2 (b) and (c) above: |

(a) A fee equivalent to the cost of such investigations and work as may be required, at €1,421 per diem, subject to a minimum charge of €128. |

(1) There shall be charged and levied by the Authority for the issue of a PART 21 subpart G approval, and for each subsequent year or part thereof in which the approval is in force a fee of €4,867. |

(2) There shall be charged and levied by the Authority for approval of an organisation for the manufacture of aircraft seating foams, carpets or dress fabrics a fee of an amount equivalent to the cost of such investigations and work as may be required for the purposes of the grant of such an approval subject to a minimum fee of €2,292 and €1,171 for each renewal. |

FEES FOR INSPECTION FOR THE PURPOSES OF APPROVAL OF A PREMISES (STORAGE OF AIRCRAFT PARTS) |

(1) There shall be charged and levied by the Authority for the approval of a premises as suitable for the storage of aircraft accessories and component parts, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to the following minimum fees: |

||||||||
FEES FOR THE GRANT, CONTINUANCE OR CHANGE OF AN AIR OPERATOR CERTIFICATE (AOC) |
||||||||
(1) There shall be charged and levied for the inspection and surveillance of an aircraft operator’s organisation for the purposes of the grant, annual continuance or change of an Aircraft Operator’s Certificate, a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to the following minimum charges appropriate to the maximum total weight authorised (MTWA) of the heaviest type of aircraft specified in the application: |

(a) Grant of an AOC |

||||||||
Where an application is made for a change to an approval, there shall be charged and levied for the investigations and work as may be required by the Authority a fee of €1,421 per diem in each case, subject to a minimum fee of €1,000. |
||||||||
Note: Charges in respect of the renewal of an AOC may, at the discretion of the Authority, be rebated by the value of 15% of the CofA fees paid by that operator. |
||||||||
(2) There shall be charged and levied for aircraft not registered in the State an additional fee for each month during which the aircraft is, or are, included in the certificate: |
||||||||
(a) in respect of each aircraft of maximum total weight authorised (MTWA) of not more than 2,000 kg € 75; |
||||||||
(b) in respect of each aircraft of a maximum total weight authorised of more than 2,000 kg €15 for every 500 kg of the MTWA or part thereof. |
||||||||
(3) Where the Authority has agreed that an operator holding an Air Operator Certificate from the Authority may engage in an aircraft operation based in another EU member state, there shall be charged and levied for the inspection by the Authority of that operation so based a surveillance fee of €1,421 per diem per inspector in addition to the cost of travel and subsistence for Authority personnel engaged in surveillance of that operation. |
||||||||
(4)(a) Where an application is made for the grant of an approval to operate an aircraft type in RVSM (Reduced Vertical Separation Minima) airspace or the grant of an ETOPS (Extended Twin Engine Operations) approval for an aircraft type, there shall be charged and levied for the grant of such approval a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority in each case, subject, in the case of RVSM, to a minimum fee of €4,637 and in the case of an ETOPS approval to a minimum fee of €9,272. |
||||||||
(b) There shall be charged and levied for an inspection for the purpose of authorising a commercial air transport operator to carry dangerous goods under the terms of an Air Operator Certificate a fee of an amount equivalent to the cost of the inspection subject to a minimum fee of €448 per annum. |

FEES FOR INSPECTION OF AN AIRCRAFT TO DETERMINE IF IT IS AIRWORTHY |
||||||||
(1) There shall be charged and levied for an inspection, on the application of an owner of an aircraft (not being an inspection made with a view to issuing or renewing or validating a certificate of airworthiness or issuing a certificate of airworthiness for an aircraft intended for export) for the purpose of ensuring that an aircraft is airworthy and complies with the requirements for the issue of a certificate of airworthiness, a fee of an amount equivalent to the cost of the inspection subject to a minimum fee as appropriate to the aircraft concerned under Schedule 2 [airworthiness fees] of the Order. |

SCHEDULE 13 |
||||||||
FEES FOR THE APPROVAL OF AIRCRAFT MAINTENANCE ENGINEER TRAINING COURSES AND TRAINING ORGANISATIONS |
||||||||
(1)(a) There shall be charged and levied for the grant and the renewal of a PART 147 approval for an aircraft maintenance engineer training organisation: |
||||||||
|
||||||||
(b) Where the services described above are provided in another state (other than Northern Ireland), an additional charge of €1,421 per diem or part thereof plus the cost of travel, accommodation and subsistence for each Authority Inspector required will be charged in addition to the fees specified above. (Note: for the purpose of this Schedule, the number of days charged for shall commence when the Authority Inspector leaves home to travel abroad and shall end when the Authority Inspector arrives back at home). |
||||||||
(2) There shall be charged and levied for the audit of a Training Course and / or examination at a location not listed in the Maintenance Organisation’s MTOE, a fee equal to the cost of such an audit subject to a minimum fee of €247. |
||||||||
(3) There shall be charged and levied for the approval and renewal of an approval for a course of type training for persons applying for an Aircraft Maintenance Engineer’s Licence an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to a minimum fee of €247. |
||||||||
(4) There shall be charged and levied for the initial approval of a PART 147 multimedia based training course an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to a minimum fee of €3,082. |
||||||||
(5) There shall be charged and levied for the review and approval of a revision to a PART 147 multimedia based training course an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to a minimum fee of €1,027. |
||||||||
(6) There shall be charged and levied for the renewal of an approval of a PART 147 multimedia based training course a fee of €3,082. |
||||||||
(7) There shall be charged and levied for the provision of training courses by the Authority an amount equivalent to the cost of providing such training courses subject to a minimum fee of €1,421 per diem. |
||||||||
(8) For a copy of a document held by the Authority and available and to which the applicant may receive a copy, a charge of €30 per document shall apply. |

FEES FOR INSPECTIONS IN RELATION TO DANGEROUS GOODS |
||||||||
(1)(a) There shall be charged and levied for an inspection for the purpose of ensuring compliance with the provisions of the Air Navigation (Carriage of Munitions of War, Weapons and Dangerous Goods) Orders, 1973 and 1989 ( S.I. No. 224 of 1973 and S.I. No. 130 of 1989 ), a fee of an amount equivalent to the cost of the inspection subject to a minimum fee of €448. |
||||||||
(b) There shall be charged and levied for the approval and renewal of an approval for a course of dangerous goods training for persons applying for an approval to ship or transport dangerous goods a fee of €448 per annum. |
||||||||
SCHEDULE 15 |
||||||||
FEES FOR THE INSPECTION AND APPROVAL OF FUEL INSTALLATIONS AT AERODROMES, HELIPORTS OR ELSEWHERE |
||||||||
(1) There shall be charged and levied for the inspection for the purposes of issuing or renewing an approval of an aviation fuel installation, located at any place where aircraft may take-off or land within the State, other than at an aerodrome or a place under the control of the Minister for Defence, a fee of an amount equivalent to the cost of such inspection, subject to the following minimum fees: |
||||||||
(a) Inspection for the issue or renewal of an approval of an installation at a licensed aerodrome, a fee per inspection of €448; |
||||||||
(b) If the Approval for a Fuel installation is held by the holder of a Class C aerodrome licence and renewed in conjunction with the aerodrome licence, the combined renewal fee shall be that defined in Schedule 18, 2 (c) (v) hereunder; |
||||||||
(c) For all other installations, a fee per inspection of €448. |
||||||||
SCHEDULE 16 |
||||||||
FEES FOR THE ASSESSMENT OF STUDENT AIR TRAFFIC CONTROLLERS, AIR TRAFFIC CONTROLLERS AND AERODROME FLIGHT INFORMATION SERVICE OFFICERS |
||||||||
(1) There shall be charged and levied by the Authority for the practical assessment of student air traffic controllers, air traffic controllers and aerodrome flight information service officers, a fee of an amount equivalent to the cost of such investigations and work as may be required by the Authority for the purpose of such assessments subject to the following minimum fees: |
||||||||
(a) for the assessment of student air traffic controllers or air traffic controllers, a fee of €400; |
||||||||
(b) for the assessment of aerodrome flight information service officers, a fee of €200. |
||||||||
(2) There shall be charged and levied by the Authority for the simulator assessment of student air traffic controllers or air traffic controllers, a fee of an amount equivalent to the cost of such investigations and work as may be required for the purpose of such assessment subject to a minimum fee of €400. |

FEES FOR LICENCES FOR STUDENT AIR TRAFFIC CONTROLLERS, AIR TRAFFIC CONTROLLERS AND AERODROME FLIGHT INFORMATION SERVICE OFFICERS |

(1) There shall be charged and levied for the grant, renewal and validation of licences and associated ratings for student air traffic controllers, air traffic controllers and aerodrome flight information service officers the fees as set out in this Schedule. |
||||||||
(2) The fee for the replacement of any licence shall be 50% of the fee specified for the grant thereof. |
||||||||

SCHEDULE 18 |
||||||||
FEES FOR AERODROME AND HELIPORT LICENCES AND CERTAIN OTHER FEES FOR AERODROMES AND HELIPORTS |
||||||||
(1) There shall be charged and levied for the grant, renewal or variation of a licence for an aerodrome or heliport the fees as set out at (2) below. |
||||||||
(a) The fee specified for the grant, renewal or variation of an aerodrome or heliport licence includes the cost of inspection of the site or proposed site of the aerodrome or heliport. Should a licence not be granted, renewed or varied (as the case may be) the fee appropriate to inspection only shall be retained by the Authority. |
||||||||
(b) For the purposes of this Schedule, aerodromes and heliports are classified as follows: |
||||||||
(i) Class A1 - Aerodromes: Aerodromes, having a Control Zone and/or Instrument Approach and having at least one runway of length 1800m or more, which are licensed for public use; |
||||||||
Class A2 - Aerodromes: Aerodromes, having a Control Zone and/or Instrument Approach and having at least one runway of length 1200m or more and less than 1800m, which are licensed for public use; |
||||||||
Class A3 - Aerodromes: Aerodromes, having a Control Zone and/or Instrument Approach and having no runway of length greater than 1200m, which are licensed for public use; |
||||||||
(ii) Class B - Aerodromes: Aerodromes, without a Control Zone or Instrument Approach, which are licensed for public use (VFR- DAY); |
||||||||
(iii) Class C - Aerodromes: Aerodromes which are licensed for Private and/or Aerial Work use only (including use for student pilot training); |
||||||||
(iv) Class A - Heliports: Heliports, with a Control Zone and/or Instrument Approach, which are licensed for public use; |
||||||||
(v) Class B - Heliports: Heliports, without a Control Zone or Instrument Approach, which are licensed for public use (VFR-DAY); |
||||||||
(vi) Class C - Heliports: Heliports which are licensed for Private and/or aerial work use only (including use for student pilot training). |
||||||||
(2)(a)(i) For the grant or renewal of a Class A1 - Aerodrome licence, a minimum fee of €4,565 per year and an additional variable charge for commercial movements in excess of 10,000 per year at a rate to be prescribed in a direction under this Order; |
||||||||
(ii) For the grant or renewal of a Class A2 - Aerodrome Licence, a fee of €2,462 per year; |
||||||||
(iii) For the grant or renewal of a Class A3 - Aerodrome licence or a Class A - Heliport licence: a fee of €1,785 per year; |
||||||||
(iv) For a variation in the terms or conditions of a Class A - Aerodrome licence or a Class A - Heliport licence, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €515; |
||||||||
(v) For approval of a new Instrument Approach, a fee of an amount equivalent to the cost of such investigations as may be required, subject to a minimum fee of €507; For the design and approval of a new Instrument Approach, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €2,462; |
||||||||
(vi) For inspection of the proposed site for an aerodrome or heliport (Class A - Aerodrome licence or Class A - Heliport licence), a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €2,462. |
||||||||
(b)(i) For the grant or renewal of a Class B - Aerodrome or a Class B - Heliport licence, a fee of €1,454 per year; |
||||||||
(ii) For a variation in the terms or conditions of a Class B - Aerodrome licence or a Class B - Heliport licence, a fee of an amount equivalent to the cost of such investigations as may be required, subject to a minimum fee of €515; |
||||||||
(iii) For inspection of the proposed site for an aerodrome or heliport (Class B - Aerodrome licence or Class B - Heliport licence), a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €2,097. |
||||||||
(c)(i) For the grant or renewal of a Class C - Aerodrome licence or a Class C - Heliport licence, a fee of €895 per year; |
||||||||
(ii) For a variation in the terms or conditions of a Class C - Aerodrome licence or a Class C - Heliport licence, a fee of an amount equivalent to the cost of such investigations or work as may be required, subject to a minimum fee of €269; |
||||||||
(iii) For the temporary upgrading of a Class C - Aerodrome licence to a Class B– Aerodrome licence or of a Class C - Heliport licence to a Class B - Heliport licence the cost of the higher licence shall be charged, adjusted pro rata according to the period of the upgrade, and taking account the fee already paid in respect of that period, subject to a minimum fee of €515; |
||||||||
(iv) For inspection of the proposed site for an aerodrome or heliport (Class C - Aerodrome licence or Class C - Heliport licence), a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €515; |
||||||||
(v) For a renewal of a Class C aerodrome licence in combination with the renewal of an aerodrome fuel approval, where the fuel approval is held by the aerodrome licensee, the combined renewal fee for both shall be €1,000. |
||||||||
(3) There shall be charged and levied for the grant of a permission, where such is required, or a temporary licence, to use a place not licensed as an aerodrome as a place for the take-off and landing of aircraft, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €559. |

SCHEDULE 19 |

FEES FOR AN APPROVAL CERTIFICATE AND A CERTIFICATE OF COMPLIANCE IN RESPECT OF AIR TRAFFIC SERVICES, SYSTEMS AND EQUIPMENT OR A CERTIFICATE ISSUED IN ACCORDANCE WITH ARTICLE 7 OF REGULATION (EC) No. 550 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL |
||||||||
(1) There shall be charged and levied for an approval certificate for air traffic services or a certificate confirming the compliance of air traffic service systems and equipment with the requirements specified by the Authority in relation thereto a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum rate of €1,421 per person per diem. This fee shall also be charged and levied for certificates issued by the Authority to Air Navigation Service Providers in its capacity as the National Supervisory Authority in accordance with Article 4 of Regulation (EC) No. 549/2004 of the European Parliament and of the Council. |

FEES FOR LICENCE SKILL TESTS (LST), LICENCE PROFICIENCY CHECKS (LPC) AND ASSESSMENT OF COMPETENCE (AoC) IN AIRCRAFT AND SIMULATORS |

(1) GENERAL |
||||||||
(a) There shall be charged and levied for LSTs, LPCs and AoCs conducted to assess the skill of applicants for the grant, renewal or revalidation of various flight crew licences, associated ratings and certificates or, where required, for the validation of licences issued by the relevant authorities of other states, fees as set our hereunder for aircraft certificated for single-pilot and multipilot operation. |
||||||||
(b) For the purposes of this Schedule, the term "Professional Flight Crew Licence" includes a Commercial Pilot Licence (CPL), a Multi Pilot Licence (Aeroplane) (MPL[A]), an Airline Transport Pilot Licence (ATPL) and a Flight Engineer Licence (FEL). "A, B, H, S, AS, PL" is an abbreviation for "Aeroplane, Free Balloon, Helicopter, Sailplane, Airship and Powered Lift". "TMG" is an abbreviation for "Touring Motor Glider", as defined in PART FCL. |
||||||||
(c) For the purposes of this Schedule, the fees prescribed shall be the maximum chargeable by an examiner other than for additional fees necessarily incurred in order to carry out the LST, LPC and AoC assigned by the Authority. |
||||||||
(2) CLASSIFICATION OF FLIGHT TESTS |
||||||||
For the purpose of this Schedule, flight tests are classified as follows: |
||||||||
(a) Licence Skill Tests (LSTs). |
||||||||
(b) Licence Proficiency Checks (LPCs). |
||||||||

||||||||

(4) SUPPLEMENTARY PROVISIONS FOR FLIGHT TEST FEES |
||||||||
(a) Failure to attend for flight test |
||||||||
Where a flight test candidate does not attend for the flight test arranged by the Authority and such absence has not been excused by prior arrangement with the flight test examiner the candidate’s fee shall be forfeited. |
||||||||
(b) Withdrawal from flight test |
||||||||
Where a flight test candidate withdraws the flight test application arranged by the Authority before any costs have been incurred by the flight test examiner, they may be paid a refund of the flight test fee less an administration fee of €100. Where a flight test candidate withdraws the flight test application arranged by the Authority after costs have been incurred by the flight test examiner, the rules applicable to failure to attend as set out in (a) above shall apply. |
||||||||
(c) Failure to provide aircraft for flight test |
||||||||
It is the responsibility of the applicant(s) to provide a serviceable, suitable and acceptable aircraft /simulator for the flight test(s). Where a flight test examiner attends at a location in Ireland for a flight test(s) arranged by the Authority and such test(s) cannot be carried out because of the unavailability of a serviceable, suitable and acceptable aircraft/simulator, the sum of €350 shall be forfeited by the candidate. Where such failure to provide an aircraft/simulator for a test arranged by the Authority outside Ireland and such test is being charged on a per diem basis in the manner described in paragraph 5(2) of this Schedule, the entire amount due shall be forfeited. |
||||||||
(d) Flight tests for aircraft certificated for Multi-Pilot Operation |
||||||||
Fees for flight tests for Aircraft Type ratings or instrument ratings on aircraft certificated for multi-pilot operation, requiring a flight test examiner supplied by the Authority, shall be charged on a cost recovery basis, subject to a minimum of the appropriate flight test fee specified at paragraph 3 above. |
||||||||
(e) Flight tests for Flight Engineer’s Licence |
||||||||
Fees for a flight test, when required, for the grant, renewal, re-issue or validation of a Flight Engineer Licence shall be charged on a cost recovery basis, subject to a minimum of the appropriate flight test fee specified at paragraph 3 above. |
||||||||
(f) Skill tests conducted in an aircraft simulator |
||||||||
Fees for skill tests conducted in an aircraft simulator shall be charged on a cost recovery basis subject to a minimum of the appropriate flight test fee for the licence or rating sought as specified in this Schedule. |
||||||||
(g) Delegated flight tests |
||||||||
Flight tests delegated to an external flight test examiner may be charged at the rates applicable to the particular flight test as set out in this Schedule. |
||||||||
(5) FLIGHT TESTS OR ASSESSMENTS GIVING RISE TO EXTRAORDINARY COSTS |
||||||||
(1) Notwithstanding the foregoing provisions of this Schedule, where any flight tests are conducted which, due to the particular circumstances (including medical flight tests), give rise to extraordinary costs, such costs shall be recovered through increased fees which shall be notified to and agreed with the flight test candidate(s) in advance. |
||||||||
(2) For flight tests which are conducted outside of the island of Ireland (for this purpose the island of Ireland is regarded as including Northern Ireland), such flight tests may, at the discretion of the Authority and with prior notification to the candidate or organisation being charged, be charged on the basis of recovery of the examiner’s travel, subsistence and accommodation costs in addition to a flat rate of €1,421 per day or part thereof (Note: for the purpose of this Schedule, the number of days charged for shall commence when the examiner leaves home to travel abroad and shall end when the examiner arrives back at home). Such costs shall be payable irrespective of whether or not the tests in question are achieved or fail to take place due to unsuitable weather, unserviceable equipment or any other adverse factor outside the control of the Authority. In cases where flight tests are arranged on the payment of a per diem rate as heretofore described, no individual fee per test shall be levied in addition. |
||||||||
SCHEDULE 21 |
||||||||
FEES FOR FLIGHT CREW LICENCES, VERIFICATIONS AND VALIDATIONS |
||||||||
(1) GENERAL |
||||||||
(a) There shall be charged and levied for the grant, re-issue, renewal, revalidation, replacement, transfer of state of licence issue verification and validation of flight crew licences and associated ratings and for associated flight crew licence and rating services, the fees as set out hereunder and in the Appendix hereto; |
||||||||
(b) For the purposes of this Schedule, the term "Professional Flight Crew Licence" includes a Commercial Pilot Licence (CPL); a Multi Pilot Licence (Aeroplane) (MPL[A]), an Airline Transport Pilot Licence (ATPL) and a Flight Engineer Licence (FEL); |
||||||||
(c) The fees prescribed are a personal liability on the applicant flight crew member and are payable at the time of application. |
||||||||
(2) FEES PAYABLE |
||||||||
(a) A general schedule of fees payable appears as an Appendix to this Schedule; |
||||||||
(b) The fees set out in the Schedule are for the period of validity of the licence or rating in question; |
||||||||
(c) The fee for a general validation of flight crew licence shall be €294 per year or part thereof for each pilot and not to exceed a total of €4,112 per year in respect of each operator. |
||||||||
(3) SUPPLEMENTARY PROVISIONS |
||||||||
(a) Replacement of licences |
||||||||
The fee for the replacement of any licence or rating document or certificate shall be 50% of the fee specified in the Appendix hereto for the grant thereof. |
||||||||
(b) Variation and alteration of licences and ratings |
||||||||
Fees for a variation, alteration, endorsement of, or removal of a restriction on any licence or rating shall, where not otherwise provided for in the Appendix to this Schedule, be charged on a cost recovery basis subject to a minimum fee of €75. |
||||||||
(c) Exemption from licences and ratings |
||||||||

(2)(a) For permission to operate a tethered or free manned balloon for commercial transport of passengers purposes, a fee of €7,498 for an unlimited number of operations performed within a period of one year in accordance with conditions specified by the Authority. |

(b) For permission to operate a tethered or free manned balloon for aerial work purposes, a fee of €112 for any single operation, or a fee of €184 for a number of operations at a single event, or a fee of €739 for an unlimited number of operations performed within a period of one year in accordance with conditions specified by the Authority. |

(e) For permission to release a free unmanned balloon or balloons for aerial work or private purposes (other than a balloon(s) operated by the State Meteorological Services) a fee of €61 for a single operation, or a fee of €94 for a number of operations at a single event, or a fee of €358 for an unlimited number of operations performed within a period of one year in accordance with conditions specified by the Authority. |

(f) In relation to paragraph (e) above, no fee shall be payable for the grant of permission for the release of up to 2,000 balloons at any point within the State, provided such point is not closer than 5 nautical miles from a licensed aerodrome or a State aerodrome, and provided that such balloons do not exceed five hundred centimetres in any linear dimension, are made of standard rubber and have no metal tag or ribbon attached. |

(3) The fees prescribed in this Schedule may be waived if such activities have been approved and given general permission under the terms of an Operations Manual for which the appropriate fees have been paid in accordance with the provisions of Schedule 11 [AOC Fees] or Schedule 27 [Aerial Work] of this Order. |

(4) Where any investigations and work for any permissions for which fees are prescribed by this Schedule give rise to greater costs than can be recovered from the said fees, such costs shall be recovered from the applicant. |

(1)(a) There shall be charged and levied for the examination and acceptance of the Operations Manual and the Maintenance Manual in respect of an of an aerial work aircraft and for the grant of any permissions or exemptions the fees as set out at paragraph 2 below. |
||||||||
(b) For the purposes of this Schedule: |
||||||||
"aerial work aircraft" means an aircraft, not being a public transport aircraft or an aircraft flying in accordance with the proviso to paragraph (2) of Article 2 of the Irish Aviation Authority (Personnel Licensing) Order, 2000 ( S.I. No. 333 of 2000 ) as amended, which is being flown for payment required to be made, or promised to the operator of the aircraft, being a payment for the flight or in respect of the purpose for which the flight is undertaken. |
||||||||
(2)(a) For the initial examination and the acceptance of the Operations Manual and a Maintenance Manual in respect of an aerial work aircraft registered in the State, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €794. |
||||||||
(b) For the grant or renewal of a permission for an aerial work aircraft registered in the State, a fee of €148 per application. |
||||||||
(c) For each application for a variation in the terms of the Operations Manual and Maintenance Manual for an aerial work aircraft so as to include a new form of aerial work, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €148. |

(d) For each application for a variation in the terms of an existing Operations Manual and Maintenance Manual for an aerial work aircraft so as to apply it to another aircraft type, a fee of an amount equivalent to the cost of such investigations and work as may be required, subject to a minimum fee of €148. |

(b) The fees prescribed are a personal liability on the individual applicant and are payable at the time of application unless otherwise specified. |

(2) FEES PAYABLE |
||||||||
(a) A general schedule of fees payable appears as an Appendix to this Schedule; |
||||||||
(b) The fees set out in the Schedule are for the period of validity of the certificate, licence or rating in question. |
||||||||
(3) SUPPLEMENTARY PROVISIONS |
||||||||
(a) Replacement of certificates |
||||||||
The fee for the replacement of any certificate shall be 50% of the fee specified in the Appendix hereto for the grant thereof. |
||||||||
(b) Variation and alteration of certificate |
||||||||
Fees for a variation, alteration, endorsement of, or removal of a restriction on any certificate shall, where not otherwise provided for in the Appendix to this Schedule, be charged on a cost recovery basis subject to a minimum fee of €75. |
||||||||
(c) Exemption from the requirement to hold a certificate |
||||||||
Where an exemption is granted from the requirement to hold a certificate, the fee for such exemption shall be the fee specified in the Appendix hereto for the grant of the certificate in question. |
||||||||
(d) Copies of Documents |
||||||||
For a copy of a document held by the Authority and available, a charge of €30 per document shall apply. |
||||||||
(e) Theoretical Knowledge Examination Centres |
||||||||
For the initial approval of a theoretical knowledge examination centre for the provision of theoretical exams on behalf of the Authority a fee of €500 per site. |
||||||||
For ongoing surveillance of a theoretical knowledge examination centre approved for the provision of theoretical exams on behalf of the Authority a fee of €250 per site. |
||||||||
(f) Miscellaneous |
||||||||
Where a grant, renewal, re-issue or validation of any certificate, licence or rating not otherwise provided for above is required, the fees shall be determined by the Authority and notified in advance. |

MISCELLANEOUS FEES AND CHARGES |
||||||||
(1) Where the Authority is charged by the European Aviation Safety Agency for services provided by the Agency to a person or company, the Authority may recover the amount of the charge from that person or company. |
||||||||
(2) The fee payable for the grant of any exemption, permission or a change in category or class of any certificate or licence issued by the Authority in accordance with the requirements of the relevant legislation, which is not otherwise specified herein, shall be an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to a minimum fee of €123. |

(3) Unless otherwise specified in this order, the cost of investigative work as may be required shall be levied at a rate of €1,421 per day. |
||||||||
(4) The fee payable for a replacement certificate, which is not otherwise specified herein, shall be an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to a minimum fee of €71. |
||||||||
(5) The fee payable for a change to a noise certificate shall be an amount equivalent to the cost of such investigations and work as may be required by the Authority, subject to a minimum fee of €71. |
