Notice of the making of this Statutory Instrument was published in | ||

I, CHARLES FLANAGAN, Minister for Justice and Equality, in exercise of the powers conferred on me by sections 19 (as amended by section 34 (c) of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) and 20 of the Immigration Act 2004 (No. 1 of 2004) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minster) Order 2011 ( S.I. No. 138 of 2011 )), makes the following regulations: | ||
1. These Regulations may be cited as the Immigration Act 2004 (Registration Certificate Fee) (Amendment) Regulations 2017. | ||
2. In these Regulations “Regulations of 2012” means the Immigration Act 2004 (Registration Certificate Fee) Regulations 2012 ( S.I. No. 444 of 2012 ). | ||
3. Regulation 2 of the Regulations of 2012 is amended— | ||
(a) by the deletion of the definition of “Act of 1996”, and | ||
(b) by the insertion of the following definition: | ||
“ ‘Act of 2015’ means the International Protection Act (No. 66 of 2015);”. | ||
4. Regulation 4 of the Regulations of 2012 is amended— | ||
(a) by the substitution of the following for paragraph (b): | ||
“(b) persons in respect of whom a declaration under section 47(1) of the Act of 2015 is, for the time being, in force;”, | ||
(b) by the substitution of the following for paragraph (c): | ||
“(c) persons to whom a permission has been given under section 56 of the Act of 2015 to enter and reside in the State, which permission is, for the time being, in force;”, | ||
(c) by the substitution of the following for paragraph (d): | ||
“(d) programme refugees within the meaning of section 59 of the Act of 2015;”, | ||
(d) in paragraph (f), by the substitution of “with those Arrangements;” for “with those Arrangements.”, | ||
(e) by the insertion after paragraph (f) of the following: | ||
“(g) persons in respect of whom a declaration under section 47(4) of the Act of 2015 is, for the time being, in force; | ||
(h) persons to whom a permission has been given under section 49(4)(a) of the Act of 2015, which permission is, for the time being, in force; | ||
(i) persons to whom a permission has been given under section 60(6) of the Act of 2015, which permission is, for the time being, in force; | ||
(j) persons to whom a permission has been given under section 50(4) of the Act of 2015, which permission is, for the time being, in force.”. | ||

These Regulations which amend the Immigration Act 2004 (Registration Certificate Fee) Regulations 2012 provide that certain categories of persons granted a permission or a declaration under the International Protection Act 2015 are exempt from paying the fee for obtaining a registration certificate. |
