I, KATHERINE ZAPPONE, Minister for Children and Youth Affairs, in exercise of the powers conferred on me by section 150 of the Adoption Act 2010 (No. 21 of 2010) and the Office of the Minister for Children and Youth Affairs (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 218 of 2011 ), hereby make the following Regulations: | ||
1. These Regulations may be cited as the Adoption Act 2010 (Section 85) (Fees) Regulations 2018. | ||
2. These Regulations come into operation on 18 January 2018. | ||
3. In these Regulations “Principal Act” means the Adoption Act 2010 (No. 21 of 2010). | ||
4. The prescribed fee payable in accordance with section 85(2)(a) of the Principal Act for each search of the index to the Adopted Children Register carried out by a person pursuant to that provision is— | ||
(a) where the period of time within the search dates specified for that search is 5 years or less, the amount set out in column (2) of the Schedule, opposite reference 1 in column (1), and | ||
(b) where the period of time within the search dates specified for that search is greater than 5 years and the time taken to conduct that search does not exceed 7 consecutive hours, the amount set out in column (2) of the Schedule, opposite reference 2 in column (1). | ||
5. The prescribed fee payable in accordance with section 85(3)(a) of the Principal Act for each search of the index of the Adopted Children Register carried out by an tArd-Chláraitheoir pursuant to that provision is the amount set out in column (2) of the Schedule, opposite reference 3 in column (1). | ||
6. (1) The prescribed fee payable in accordance with sections 85(2)(b) and 85(3)(b) of the Principal Act for each certified copy or certified extract of an entry in the Adopted Children Register is the amount set out in column (2) of the Schedule, opposite reference 4 in column (1). | ||
(2) The prescribed fee payable in accordance with sections 85(2)(b) and 85(3)(b) of the Principal Act for each uncertified copy of an entry in the Adopted Children Register is the amount set out in column (2) of the Schedule, opposite reference 5 in column (1). | ||
7. The Adoption Act 2010 (Section 85) (Fees) Regulations 2017 ( S.I. No. 536 of 2017 ) are revoked. | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
These Regulations set the fees required to be paid for— | ||
• obtaining copies or extracts of entries in the Adopted Children Register, and | ||
• searching the index of the Adopted Children Register. | ||
These Regulations may be cited as the Adoption Act 2010 (Section 85) (Fees) Regulations 2018 and come into operation on 18 January 2018. |
