EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
This Order appoints 1 November 2019 as the date on which the Civil Law (Presumption of Death) Act 2019 comes into operation. The Act provides for the civil status of a missing person where the circumstances of his or her absence leads to a presumption of death. A presumption of death order may be made by a court where the court is satisfied that the circumstances of the person having gone missing indicate that his or her death is either virtually certain or highly probable. |
