Notice of the making of this Statutory Instrument was published in

I, Michael Creed, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive (EU) 2020/177 of 11 February 2020¹ , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Marketing of Fruit Plant Propagating Material) (Amendment) Regulations 2020.

2. The European Communities (Marketing of Fruit Plant Propagating Material) Regulations 2011 ( S.I. No. 384 of 2011 ) are amended in Regulation 2(1) by substituting for the definition of “Directive” (as amended by European Communities (Marketing of Fruit Plant Propagating Material) (Amendment) Regulations 2020 (S.I. 29 of 2020), the following –

“‘Directive’ means Council Directive 2008/90/EC of 29 September 2008² (as amended by Regulation (EU) No 652/2014 of the European Parliament and of the Council of 15 May 2014³ , Commission Implementing Decision (EU) 2016/159 of 4 February 2016⁴ , Commission Implementing Decision (EU) 2016/1887 of 24 October 2016⁵ and Commission Implementing Decision (EU) 2019/120 of 24 January 2019⁶ , Commission Implementing Directive 2014/96/EU of 15 October 2014⁷ , Commission Implementing Directive 2014/97/EU of 15 October 2014⁸ and Commission Implementing Directive 2014/98/EU of 15 October 2014⁹ (as amended by Commission Directive (EU) 2020/177 of 11 February 2020); ”.

3. The European Communities (Marketing of Fruit Plant Propagating Material (Amendment) Regulations 2020 ( S.I. No. 29 of 2020 ) are revoked.

EXPLANATORY NOTE

These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2020/177 by amending Council Directive 2008/90/EC as it relates to inspections for Union regulated non-quarantine pests (RNQPs) and measures intended to prevent their presence on fruit plant propagating material and fruit plants intended for planting.
