I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 42 of the Public Service Pay and Pensions Act 2017 (No. 34 of 2017), being satisfied that subsection (6) of that section has been complied with; having complied with subsection (9) of that section; having had regard to the matters specified in paragraphs (a) to (e) of subsection (10) of that section, with the consent of the Minister for Public Expenditure and Reform, hereby make the following regulations: | ||||||||||||||||||||||||||
1. These Regulations may be cited as the Public Service Pay and Pensions Act 2017 (Section 42) (Payments to General Practitioners) (Amendment) Regulations 2020. | ||||||||||||||||||||||||||
2. The Public Service Pay and Pensions Act 2017 (Section 42) (Payments to General Practitioners) Regulations 2019 ( S.I. No. 692 of 2019 ) are amended – | ||||||||||||||||||||||||||
(1) by the insertion of the following definitions in Regulation 3: | ||||||||||||||||||||||||||
“ ‘Covid-19’ means a disease caused by infection with the virus SARS-CoV-2 and specified as an infectious disease in accordance with Regulation 6 of, and the Schedule to, the Infectious Diseases Regulations 1981 ( S.I. No. 390 of 1981 ) or any variant of the disease so specified as an infectious disease in those Regulations; | ||||||||||||||||||||||||||
‘data return’ means the submission by a service provider to the Health Service Executive of information in accordance with the Agreement of 2019 following a Modified Structured Chronic Disease Management Review; | ||||||||||||||||||||||||||
‘Modified Structured Chronic Disease Management Programme’ means the Chronic Disease Management Programme modified in response to the threat to public health posed by the spread of Covid-19 consisting of a Modified Structured Chronic Disease Management Review; | ||||||||||||||||||||||||||
‘Modified Structured Chronic Disease Management Review’ means a remote review consultation or a structured in-surgery review or both; | ||||||||||||||||||||||||||
‘Practice Nurse Grant’ means the fee payable to a service provider in respect of the services of a practice nurse rendered as part of the Modified Structured Chronic Disease Management Review; | ||||||||||||||||||||||||||
‘remote review consultation’ means a consultation between a service provider and a patient aged 70 years or over who has a diagnosis of one or more of the conditions mentioned in the Modified Structured Chronic Disease Management Programme that is carried out other than in person, whether by telephone or other electronic means, for the purposes of conducting a clinical review in respect of that patient’s condition rendered under and in accordance with the General Medical Services Scheme; | ||||||||||||||||||||||||||
‘structured in-surgery review’ means a consultation between a service provider and a patient aged 70 years or over who has a diagnosis of one or more of the conditions mentioned in the Modified Structured Chronic Disease Management Programme that is carried out at a general practitioner’s surgery, for the purposes of conducting a full chronic disease review, including phlebotomy, in respect of that patient, rendered under and in accordance with the General Medical Services Scheme;”, | ||||||||||||||||||||||||||
(2) by the insertion of the following Regulation after Regulation (5): | ||||||||||||||||||||||||||
“5A. Notwithstanding Regulation 5, the amount of the payment specified in column (3) of Schedule 2, Part A opposite reference numbers 1, 2 or 3 in column (1) shall not apply as the payment to be made to a service provider in respect of the particular service specified in column (2) of Part A of that Schedule if the payment specified in column (3) of Schedule 2, Part A opposite reference numbers 4, 5 or 6 in column (1) shall apply.”, and | ||||||||||||||||||||||||||
(3) by the substitution of the following Schedule for Schedule 2: | ||||||||||||||||||||||||||

These Regulations shall apply to payments in respect of the delivery of the Modified Structured Chronic Disease Management Programme by a general practitioner to or on behalf of the Health Service Executive under and in accordance with the terms of the General Medical Services Scheme -Agreement of 2019. |
