Notice of the making of this Statutory Instrument was published in | ||
“Iris Oifigiúil” of 18th September, 2020. | ||
The Property Services Regulatory Authority, in exercise of the powers conferred on it by section 79 of the Property Services (Regulation) Act 2011 (No. 40 of 2011) with the consent of the Minister for Justice and Equality, hereby makes the following regulations: | ||
1. These Regulations may be cited as the Property Services (Maintenance of Professional Competence of Licensees) (Amendment) Regulations 2020. | ||
2. The Property Services (Regulation) Act 2011 (Maintenance of Professional Competence of Licensees) Regulations 2017 (S.I. No. 576 of 2017) are amended - | ||
(a) in Regulation 2, by – | ||
the deletion of the definitions of “E-Learning”, “Professional Competence Scheme Category of General Management” and “Professional Competence Scheme Category of Legislation/Regulation”, | ||
(b) in Regulation 4, by – | ||
the deletion of paragraph (4), and | ||
(c) by substitution for Regulation 5 the following: | ||
“5. (1) Licensees shall be required to undertake a minimum of five Verifiable Hours of education and training by completion of Professional Competence Scheme Programmes in the Professional Competence Scheme Cycle. | ||
(2) The modules of the Professional Competence Scheme Programmes shall be agreed by the Authority with the Professional Competence Scheme Accredited Providers. | ||
(3) The content of the Professional Competence Scheme Programme modules, shall be submitted by the Professional Competence Scheme Accredited Providers, for approval by the Authority. | ||
(4) A Licensee shall complete all mandatory modules set out in the Professional Competence Scheme Programmes in the Professional Competence Scheme Cycle. | ||
(5) A Licensee shall not carry forward surplus hours accredited by Professional Competence Scheme Accredited Providers at the end of a Professional Competence Scheme cycle.”. | ||
The Minister for Justice and Equality consents to the making of the foregoing Regulations. | ||

EXPLANATORY NOTE | ||

These Regulations amend the Property Services (Regulation) Act 2011 (Maintenance of Professional Competence of Licensees) Regulations 2017 (S.I. No. 576 of 2017). | ||
These Regulations lay down arrangements for determining the content of the Professional Competence Scheme Programmes and allow for the delivery of the entire programmes online. |
