S.I. No. 163/2021 - Statistics (National Survey of Transport of Goods by Road) Order 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 9th April, 2021.

I, MICHEÁL MARTIN, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving full effect to Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 20121 , hereby order as follows:

1. (1) This Order may be cited as the Statistics (National Survey of Transport of Goods by Road) Order 2021.

(2) This Order comes into operation on 1 April 2021.

2. (1) In this Order -

“owner” means, in relation to a vehicle, the person by whom the vehicle is kept;

“registered” means entered in the register established and maintained under section 131(1)(a) of the Finance Act 1992 (No. 9 of 1992);

“Regulation” means Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 20121 ;

“relevant period” means the period between midnight on a Sunday immediately following the date on which notice of a direction under section 26 of the Statistics Act 1993 (No. 21 of 1993) made pursuant to the requirement prescribed under Article 4 is delivered and midnight on the following Sunday;

“scrapped”, in relation to a vehicle, means a vehicle that has been discarded or deposited for appropriate treatment and recovery under the European Union (End-of-Life Vehicles) Regulations 2014 ( S.I. No. 281 of 2014 );

“survey” means the National Survey of Transport of Goods by Road that is conducted by the Central Statistics Office for the purposes of obtaining, including for the purposes of compliance with the Regulation, information set out in the Schedule;

“user” means, in relation to a vehicle, the person in possession of the vehicle under a hire-purchase agreement or a lease;

“vehicle” means a registered goods road transport vehicle.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, other than where the context otherwise requires.

3. This Order applies to the following -

(a) a person who is the owner of a vehicle,

(b) a person who is the user of a vehicle, and

(c) a person who, immediately before it was scrapped, was the owner of a vehicle.

4. A requirement on persons to whom this Order applies to provide, annually in the period from April 2021 to March 2026 and for the purposes of the survey, information, the general nature of which is specified in the Schedule, in relation to the relevant period, is hereby prescribed.

SCHEDULE

Article 4.

1. In the case of the owner of a vehicle other than one to which paragraph 3 applies -

(a) subject to subparagraph (b), information regarding the following, as it relates to the vehicle concerned and specifying the relevant period concerned:

(i) age;

(ii) latest change of ownership;

(iii) business of the owner;

(iv) where known, business of the user;

(v) carrying capacity;

(vi) capacity of any trailer that has been attached to the vehicle;

(vii) weight of any trailer that has been attached to the vehicle;

(viii) type of body of the vehicle;

(ix) use to which the vehicle was put;

(x) use to which the vehicle is normally put;

(xi) position on the vehicle of the axles;

(xii) odometer reading in miles or kilometres of vehicle at the beginning and end of the relevant period concerned, or

(b) where the vehicle concerned is used by a person other than its owner and the owner by virtue of that fact is unable to provide all of the information specified in subparagraph (a), the name and contact details of the user of the vehicle concerned and the information specified in subparagraphs (a)(i) to (iii).

2. In the case of the user of a vehicle other than one to which paragraph 3 applies, the information specified in paragraphs 1(a)(iv) to (xii), as it relates to the vehicle concerned and specifying the relevant period concerned.

3. In the case of the owner of a vehicle that has been scrapped, confirmation of that fact.

4. Information on the time taken by the person concerned to complete the questionnaire, form or other record prepared by the Director General for the collection of the information referred to in paragraphs 1 to 3.
