S.I. No. 574/2022 - Private Security (Licensing and Qualifications) Regulations 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 18th November, 2022.

The Private Security Authority, in exercise of the powers conferred on it by section 51 (as amended by the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004), with the consent of the Minister of Justice, hereby makes the following regulations:

1. These Regulations may be cited as the Private Security (Licensing and Qualifications) Regulations 2022.

2. These Regulations come into operation on the 1st day of November 2022.

3. The Private Security (Licensing and Qualifications) Regulations 2006 ( S.I. No. 468 of 2006 ) are revoked.

4. In these Regulations -

“Act” means the Private Security Services Act 2004 as amended by the Civil Law (Miscellaneous Provisions) Act 2011 and the Private Security Services (Amendment) Act 2021 ;

“door supervisor licence” means a licence to provide a door supervisor security service issued under these Regulations and authorising a person to perform the functions of a door supervisor;

“private investigator licence” means a licence to provide a private security service issued under these Regulations and authorising a person to perform the functions of a private investigator;

“security guard (guarding)” means a person who for remuneration as a security guard-

(a) guards property for the purposes of preventing loss, damage or waste by crime, fire, carelessness or flood, or

(b) guards or patrols or provides any other protective services in relation to any premises or any other place where a public or private event or function is taking place or about to take place and includes a person who for those purposes controls, supervises, regulates, restricts or directs the movements of persons, whether in vehicles or otherwise;

“security guard (guarding) licence” means a licence issued under these Regulations and authorising an individual to perform the functions of a security guard (guarding).

5. The following categories of licence may be issued by the Authority to a person:

(a) door supervisor licence,

(b) private investigator licence,

(c) security guard (guarding) licence.

6. (a) Following are the qualifications to be held by the following categories of licensee, in so far as those qualifications are applicable to the licensee concerned:

private investigator

PSA Training Requirements for the Licensing of Private Investigator Employees (PSA 83:2021)

security guard (guarding)

QQI Level 4 Minor award 4N20604 – Security Guarding Skills or equivalent

(b) In subparagraph (a) “equivalent” means a qualification which in the opinion of the Authority is equivalent to the qualification mentioned in that subparagraph.

7. The Private Security (Licence Fee) Regulations 2015 ( S.I. No. 362 of 2015 ) are amended by the substitution of the following for regulation 4:

“Subject to Regulation 5, the fees payable to the Authority in respect of an application for a category of licence shall be determined by reference to the following table:-

The Minister for Justice consents to the making of the foregoing Regulations.
