S.I. No. 316/2023 - European Communities (Electromagnetic Compatibility) (Amendment) Regulations 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 20th June, 2023.

I, SIMON COVENEY, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2014/30/EU of the European Parliament and of the Council of 26 February 20141 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Electromagnetic Compatibility) (Amendment) Regulations 2023.

2. Regulation 3 of the European Communities (Electromagnetic Compatibility) Regulations 2017 ( S.I. No. 69 of 2017 ) is amended by the insertion of the following paragraph after paragraph (2):

“(2A) Without prejudice to the generality of paragraph (2), these regulations shall not apply to a device constructed, adapted or intended to be used to prevent the reception of radio transmissions by a receiver relevant to its function on the sole basis that it is-

(a) used by daa, public limited company, or its servants or agents, at the State airport known as Dublin Airport to interfere with the operation of an unmanned aircraft or the equipment to control such aircraft remotely (including any electronic device) for the purpose of ensuring the safety of civil aviation or public safety, or

(b) supplied to daa, public limited company, whether in return for payment or free of charge, for the purpose of use referred to in subparagraph (a).”.
