S.I. No. 427/2023 - Student Support Amendment Regulations 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 8th September, 2023.

I, SIMON HARRIS, Minister for Further and Higher Education, Research, Innovation and Science, in exercise of the powers conferred on me by sections 4 , 7 , 8 & 14A of the Student Support Act 2011 (No. 4 of 2011), and the Further and Higher Education, Research, Innovation and Science (Transfer of Departmental Administration and Ministerial Functions) Order 2020 ( S.I. No 451 of 2020 ), having consulted with the Higher Education Authority and with the consent of the Minister for Public Expenditure, NDP Delivery and Reform, hereby make the following Regulations:-

1. These Regulations may be cited as the Student Support (Amendment) Regulations 2023.

2. These Regulations shall come into operation on 28th of August 2023.

3. In these Regulations “Principal Regulations” means the Student Support Regulations 2023 ( S.I. No. 93 of 2023 )

4. Regulation 4 of the Principal Regulations is amended by inserting after paragraph 4(a)(iv) the following:

“(v) notwithstanding subparagraph (iv), the courses listed in Part C of Schedule 2 will be considered to be post-leaving certificate courses for the purposes of these Regulations.”

5. Regulation 4(b)(i) of the Principal Regulations is amended by substituting the following:

“(i) a course that takes not less than two years to complete and is provided by an approved institution that comes within the terms of section 7(1)(a), (b), (ba) or (c) of the Act and is a course listed in Part A or B of Schedule 1 or a course listed in Part D of Schedule 2 which requires the successful completion of a course listed in Part C of Schedule 2 as a condition of entry; ”

6. Schedule 2 of the Principal Regulations is amended by inserting after Part B the following:
