S.I. No. 473/2023 - Private Security Services Act 2004 (Commencement) Order 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th September, 2023.

I, HELEN MCENTEE, Minister for Justice, in exercise of the powers conferred on me by section 1 (2) of the Private Security Services Act 2004 (No. 12 of 2004) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), hereby order as follows:

1. This Order may be cited as the Private Security Services Act 2004 (Commencement) Order 2023.

2. In this Order, “Principal Act” means the Private Security Services Act 2004 (No. 12 of 2004).

3. The 29th day of September 2023 is fixed as the day on which section 37 (amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Principal Act comes into operation in respect of an individual -

(a) who provides a security service as a door supervisor, in so far as the said section 37 is not already in operation in respect of an individual who provides a security service as a door supervisor,

(b) who provides a security service as a private investigator, or

(c) who, as a security guard, provides the security services referred to in paragraph (e) of the definition of “security guard” in section 2(1) of the Principal Act.
