I, MICHAEL MCGRATH, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Regulation (EU) No 596/2014 of the European Parliament and of the Council of 16 April 20141 and of giving further effect to Directive 2014/57/EU of the European Parliament and of the Council of 16 April 20142 and Commission Implementing Directive (EU) 2015/2392 of 17 December 20153 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Market Abuse) (Amendment) Regulations 2023. | ||
2. The European Union (Market Abuse) Regulations 2016 ( S.I. No. 349 of 2016 ) are amended by the insertion of the following Regulation after Regulation 8: | ||
“Market abuse occurring partly in State | ||
8A. A person may be tried in the State for an offence under Regulation 5, 6 or 7 if any one or more of the acts alleged to constitute the offence were committed in the State, notwithstanding that the other acts alleged to constitute the offence were committed outside the State.”. | ||
