S.I. No. 680/2023 - Employment Permits (Amendment) (No.3) Regulations 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 22nd December, 2023.

I, NEALE RICHMOND, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by sections 14 , 29 and 30 (as amended by sections 17 , 29 and 30 of the Employment Permits (Amendment) Act 2014 (No. 26 of 2014)) of the Employment Permits Act 2006 (No. 16 of 2006) (as adapted by the Business, Enterprise and Innovation (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 519 of 2020 )) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) Order 2023 ( S.I. No. 14 of 2023 ), hereby make the following regulations:

Citation

1. (1) These Regulations may be cited as the Employment Permits (Amendment) (No. 3) Regulations 2023.

(2) The collection citation “the Employment Permits Regulations 2017 to 2023” includes these Regulations.

Commencement

2. Regulations 5, 6, 7, 9 and 10 come into operation on 17 January 2024.

Definitions

3. In these Regulations—

“Principal Regulations” means the Employment Permits Regulations 2017 ( S.I No. 95 of 2017 );

“Regulations of 2022” means the Employment Permits (Amendment) (No. 3) Regulations 2022 ( S.I. No. 677 of 2022 );

“Regulations of 2023” means the Employment Permits (Amendment) (No. 2) Regulations 2023 ( S.I. No. 439 of 2023 ).

Amendment of Regulation 3 of Principal Regulations

4. Regulation 3 (as amended by Regulation 3 of the Regulations of 2022) of the Principal Regulations is amended by substituting for the definition of “fast food outlet” the following:

“‘fast food outlet’ means a type of quick service food establishment where precooked or quickly prepared food such as burgers, chips or pizzas is served, whether dine in, take at the counter to go, or drive through;”.

Amendment of Regulation 18 of Principal Regulations

5. Regulation 18(1)(a) (as amended by Regulation 6 of the Employment Permits (Amendment) (No. 2) Regulations 2019 ( S.I. No. 333 of 2019 )) of the Principal Regulations is amended—

(a) by substituting “€38,000” for “€32,000”, and

(b) by substituting “€18.74” for “€15.78”.

Amendment of Regulation 20 of Principal Regulations

6. Regulation 20(2) (as amended by Regulation 5 of the Employment Permits (Amendment) Regulations 2020 ( S.I. No. 156 of 2020 )) of the Principal Regulations is amended—

(a) by substituting “€38,000” for “€32,000”, and

(b) by substituting “€18.74” for “€15.78”.

Amendment of Regulation 29 of Principal Regulations

7. Regulation 29(1) (as amended by Regulation 6 of the Regulations of 2022) of the Principal Regulations is amended by substituting for subparagraphs (a) to (h) the following:

“(a) in the case of employment as—

(i) a horticulture worker,

(ii) a meat processor operative,

(iii) a health care assistant,

(iv) a care worker, or

(v) a home carer,

the minimum remuneration is €30,000 and in respect of which the minimum hourly rate of remuneration is €14.79, and

(b) in any other case, the minimum annual remuneration is €34,000 and in respect of which the minimum hourly rate of remuneration is €16.77.”

Amendment of Regulation 30 of Principal Regulations

8. The Principal Regulations are amended by substituting for Regulation 30 (as amended by Regulation 3 of the Regulations of 2023) the following:

Maximum number of General Employment Permits for certain employments

30. The maximum number of General Employment Permits that may be granted in respect of employment in the employments listed in the first column of the table in Schedule 7 is the corresponding number in the second column of that table and the period during which that maximum number shall be granted is the period from the corresponding date in the third column of that table until the maximum number is granted.”.

Amendment of Regulation 36(1) of Principal Regulations

9. Regulation 36(1) (as amended by Regulation 11 of the Employment Permits (Amendment) Regulations 2018 ( S.I. No. 70 of 2018 )) of the Principal Regulations is amended—

(a) in subparagraph (a)—

(i) by substituting “€46,000” for “€40,000”, and

(ii) by substituting “€22.68” for “€19.72”;

(b) in subparagraph (b)—

(i) by substituting “€34,000” for “€30,000”, and

(ii) by substituting “€16.77” for “€14.79”.

Amendment of Regulation 43(1) of Principal Regulations

10. Regulation 43(1) of the Principal Regulations is amended—

(a) by substituting “€46,000” for “€40,000”, and

(b) by substituting “€22.68” for “€19.72”.

Amendment of Schedules 3 and 4 to Principal Regulations

11. The Principal Regulations are amended by substituting for Schedules 3 (as amended by Regulation 6 of the Employment Permits (Amendment) Regulations 2022 ( S.I. No. 273 of 2022 )) and 4 (as amended by Regulation 4 of the Regulations of 2023) the Schedules set out in the Schedule 1 to these Regulations.

Insertion of Schedule 7 into Principal Regulations

12. The Principal Regulations are amended by inserting after Schedule 6 the Schedule set out in Schedule 2 to these Regulations.

• is in a third level institution governed by the Irish Universities Act 1997 (No. 24 of 1997), the Institutes of Technology Act 2006 (No. 25 of 2006) and the Technological Universities Act 2018 (No. 3 of 2018); or

• involves delivering a programme largely or wholly concerned with information and communications technology, which leads to a major award at QQI level 8 and/or level 9 as validated by Quality and Qualifications Ireland.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the Employment Permits Regulations 2017 to provide for—

- a new definition of “fast food outlet”,

- new minimum annual remuneration and hourly rates of remuneration,

- new quotas for General Employment Permits in certain employments,

- introduce further quotas in certain employments,

- changes to the list of employments in respect of which there is a shortage in respect of qualifications, experience or skills which are required for the proper functioning of the economy, and

- changes to the list of employments in respect of which an employment permit shall not be granted.

These Regulations may be cited as the Employment Permits (Amendment) (No. 3) Regulations 2023.
