CASE REF: 5/06 FET
CLAIMANT: Raymond McGreevy
RESPONDENT: Police Ombudsman's Office for Northern Ireland
Constitution of Tribunal:
Chairman: Mr D Buchanan
Appearances:
The claimant appeared in person.
The respondent was represented by Mr D Dunlop, Barrister-at-Law, instructed by Napier & Sons, Solicitors.
(i) The said decision of 14 March 2006 is revoked because it is in the interests of justice to do so.
I am satisfied, having heard evidence adduced on behalf of the respondent and having had regard to the submissions made by the parties, that the respondent's failure to present its response to the Office of the Tribunals by 8 February 2006 was due to an administrative oversight on the part of its staff.
(ii) That the response presented by the respondent on 22 February 2006 be accepted and dealt with in accordance with Rule 5(2) of the Fair Employment Tribunal Rules of Procedure set out in Schedule 1 of the Fair Employment Tribunal (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.
