800/11
CLAIMANT: Fiona McGeady
RESPONDENT: North West Regional College
DECISION ON A REVIEW HEARING
The decision of the Tribunal is that the Tribunal’s Order striking-out the claimant’s claim is revoked and the respondent is awarded costs in the sum of £750.00 plus VAT.
Constitution of Tribunal:
Chairman (sitting alone): Mr P Kinney
Appearances:
The claimant was represented by Mr Crawford, Solicitor, of PM Associates.
The respondent was represented by Mr C Hamill, Barrister-at-Law, instructed by Worthingtons, Solicitors.
Issues
1. This review hearing was arranged to consider:-
“Whether the Tribunal should provide relief from sanction, namely the decision to strike-out the claimant’s claim made on 4 July 2012.”
I have decided that the claimant’s application is successful and I have revoked the Strike-out Order. The claimant’s claim will now continue to main hearing. I gave reasons for my decision orally at the hearing.
2. I further decided, on the application of the respondent’s representative, that the claimant should pay costs to the respondent in the sum of £750.00 plus VAT, for reasons also given orally at the hearing.
3. I have made the following directions/orders:-
(1) The hearing of this case on 15 – 17 October 2012 is postponed.
(2) The respondent will provide witness statements by 28 September 2012.
(3) The claimant will provide any supplementary witness statement she intends to provide by 12 October 2012.
(4) The case is listed for:-
26 – 28 November 2012
(5) The Tribunal will read the witness statements on the morning of 26 November 2012 and evidence will commence at 2.00 pm on 26 November 2012 with the parties giving evidence by way of cross-examination.
