THE INDUSTRIAL TRIBUNALS
CASE REF: 2389/06
CLAIMANT: Morag Steenson
RESPONDENTS: 1. Colin Gillian
2. Suzanne Gillian
3. Busy Mum's Recruitment Agency
DECISION
The unanimous decision of the tribunal is that the claim be dismissed.
Constitution of Tribunal:
Chairman: Mr Davey
Members: Mr H McConnell
Mr J P Magennis
Appearances:
The claimant did not appear.
The respondent did not appear.
REASONS
1. There was no appearance by any party. The tribunal considered it appropriate to deal with the matter in the absence of the parties taking into account the information available in the originating application and the response of the third respondent. No response was presented by or on behalf of the first and second respondents.
2. There was insufficient evidence in the papers to enable the tribunal to determine with any certainty which, if any, of the respondents was the claimant's employer. This is a necessary precondition to establishing any right to unfair dismissal under Article 126 of the Employment Rights (Northern Ireland) Order 1996. As the claimant has not discharged this burden the claim must fail.
